Hi,
I am an International Student from India currently on F1 and in the year of 2008. I was offered an internship through my thesis advisor's reference which I accepted. I worked from 15th September 2008 to 31st December 2008. Naturally as I was on F1 I did not know all about the tax, immigration and other laws. So I got an authorization from school for that internship and received a new I-20 (CPT) with that employer's info on 3rd page of it. I worked full time and I always had an impression I was an employee(trust me I did not know any difference between W2 and 1099 that time). I was working in the company and not anywhere else.
The problem arose when in 2009 I got a 1099 MISC instead of a W2. As I did not know about it, I did not complain and I filed my taxes correctly and got my refund. If I knew, they were going to give me 1099 MISC then I would not have accepted the offer. Starting 2009 I was on payroll (W2) and this year(2010) I got W2 for 2009.
So my question to you guys is
1. Was I out of status during the time of 1099 MISC? (I did not intentionally engage in 1099 MISC as I was unaware of it)
2. As the internship was authorized by DSO (in turn Department of Homeland Security) as I received a new I-20 mentioning the employer's info. Did I do anything illegal?
3. If in future, I apply for a H1B/Greencard through an employer(same or different). Would this incident hurt me and may cause denial of I-485?
Any help would be greatly appreciated.

140 processing has got nothing to do with your country of origin. Country of origin is used for quotas in AOS/485

Most states would have domicile requirements that require you to have resided in the state for x number of months/years.

Hello,
I will be getting married to a H1 holder in India and because of the time involved in obtaining a marriage certificate, am planning to leave shortly after the wedding with my existing B2/tourist visa. What are my options of applying for a H4 once I do that - would I have to come back to India to apply for that, or can it be done from Canada/Mexico - are there any risks pertaining to intent of travel associated with such an action. Thanking you in advance for valuable help in this matter!

Hi Gurus,
I have filled 485 on July 2nd. I have received receipts on Aug22 but my son 485 got rejected due to checks are not signed(my lawyer forgot to sign). CIS told me they sent back the 485 packet to my lawyer, but my lawyer is saying he did not received. On line status/ CIS officer told me to re-submit the file.
I am trying to re-file. Is any body faced this type of problem? Did USCIS accepted the file? Whom should i send this file or is there specific person like "Supervisor" or "Manager"
My lawyer is not supporting, he is giving hard time.
I am waiting for your valuable response.

Although I am not going anywhere, as summer rolls along, visions of distant lands dance in my head. However, that vision is marred by long lines at the airports--- getting your luggage checked, getting into a plane with carry on bags and no overhead place, and finally the immigration and customs line ups.
This year, for a fee, the Government and even some airlines are helping to ease that pain.
The US Government, (and some foreign Government as well like Holland) has introduced the Global Entry Program. US Citizens over the age of 14 can pay a fee of $100/- (valid for 5 years) and enroll in the program. They have to enter their data in the following web site:
https://goes-app.cbp.dhs.gov/ (http://goes-app.cpb.dhs.gov)
After the completion of the process, there will be a one time only CBP interview.
However, once its complete, you do not need to stand in any immigration line. There are kiosks in most major airports. The traveler has to scan in their passport at airport kisoks, and zoom down to luggage claim.
Similarly, in Houston IAH, international travelers who are US Citizens and has no checked luggage, can go through the lines used by pilots and air hostesses for faster processing.
This process can be used by anyone, but because of the lengthy process to get into the program, its probably feasible for frequent business travelers only. The travelers also get expedited check in in kiosks of other participating countries as well. As more countries sign on, the price may come down. Or this may simply become a requirement for foreign travel in the future. It will save money on personnel for countries participating in this program.
Additionally, some airlines are also letting passengers cut in line for boarding the plane or for checking in for a fee. Both American and South West is going to be offering this perk for a fee ranging from $10/- to $50/- per ticket.
This will be the future of travel, in a world increasingly short for time. But then, in this world, will there even be time for vacations?

a couple of comments. i agree with el hacko and jliechty that the front strawberry should be the one in focus. the ones that are in focus are not special and you can't see the entire berry so there is no compelling reason to focus on them. at least the one in the front is whole and big.
you might also want to 'soften' the light and eliminate the hot spots (overexposed) that are on the fruit. there should be more pretty color where you see white. you can use bounce flash or a diffuser to accomplish this and still get the bright look.
adding more attractive texture to the strawberries might be accomplished with some water droplets, especially on the leaves which look kind of dry.
food photography is one of the hardest disciplines but you're doing a great job.

Then I applied adjustment of status and got an I485 RFE. Have not got the letter yet but got the email that my case is on hold right now. Can you tell me about the RFE? Is that common? Is that the first step of denial? I'm so nervous right now. I will write what they are asking when I got the letter which I'm expecting on Tuesday or Wednesday. Thank you very much.

fionaapple20: Safest and clean route is to find an another employer and transfer H1B. Make sure your current employer does not revoke your 140, in case if its not approved. Additionally, it is highly recommended to invoke AC21 after your 140 is approved and 180 days passed.

I have an approved I-140 and my 3-year H1-B extension is currently being processed but not in premium and has not been approved yet.
I have decided to leave the job/country and want to know if there were any consequences of leaving without the approval (current I-94 has a July 2010 expiration date). I am still working and technically in status as it is in process but the approval could take a few more months. Should I push for premium? Any advice? I would hate to have any problems with getting future visas to the US, either tourist or getting back on an H1-B.
