I am going to complete 6 years on H1-B by 2009 March. When we applied for the H1-B Transfter to my current company last year for some reason I got the extension upto Jan 2010 which is more 6 yrs.
I was on L1 until 2004 Jan for 9 months in the begining and my previous company converted L1 to H1 in Jan 2004.
My question is do I need apply H1-B extension on approved I-140 to get 3 more years extension as 2010 Jan will be my 7th year on H1-B ? OR I can wait upto current transfered H1 - B approval validity?
Please advise.

If you want to retain your priority date your I 140 should be approved from your old employer, else you need to start from scratch again.

My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.
In the mean while I am thinking about switch the employer.
I am in 8 th year extension and My VIsa is valid until jan 2008.
1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.
2.What are the pros and cons I should think about when I switch the company.?

I'm currently getting everything ready to mail my forms to get a green card through marriage. I've heard that I would have to send an employment verification letter from his boss. But some people say it's optional, I only send it if I want to because he's already got his taxes done proving he can afford to support me.
If I do have to send the letter, do I need anything else along with it as proof? Either to mail them alongside the letter or for the interview?
Any help will be much appreciated. I've heard conflicting stories and don't know what to think.

Hi there,
I am currently 29 yrs old. I have had my green card for 9 years now. However, I was arrest when i was in college at the age of 20, was convicted of a misdemeanor account of drug possession. Youth and stupidity some times does go hand in hand. :mad:
My question is this, should i apply for citizenship next year, GC expiring 2010. Or should I just extend GC. I have stay out of trouble ever since, not even a speeding ticket. I have turned my life around and currently a home owner. :rolleyes:
Does anyone know any case of a successful naturalization of a drug case that was none marijuana related? Any advice is greatly appreciated... thanks in advance!!;)

Hi
I just checked my status on line and saw a LUD on my and my wife's pending 485 applications. My priority date is March 2006.
One reason that I am thinking off is that i had a service request opened on 8/22 when i went for infopass appointment and I recd a letter from USCIS dated Sept 30th with the usual template of saying that "we are processing your application bla bl bla and if you dont hear anything from us in 6 months please call us bla bla bla....."
However the LUD is not 9/30 but 10/7. I am wondering if anyone else has seen LUDs on their applications.
My AP and EAD have been renewed long back (about 1 month back).
Any response in this respect is appreciated

Can this agency be any more incompetent? This will likely lead to lawsuits by those who were "mistakenly" notified that they were selected. Glad I didn't get a notice this year. I would be very upset.

Hello, I apologyze for not giving my name away first of all, secondly I need to know what my options are if my father and mother who are permanent residents in the USA can file an I-130 for me? They obtained their legal status thru the department of labor but at the time they were approved I was already 21 years of age (the whole process started in 2000and lasted for 5 years or so); one lawyer told me that I cannot do anything since I was over 21 but I just have been in a different lawyer who told me that yes I can adjust my status thank to a grandfather law that can help me to achieve my goal in working legally in this country. I am an unmarried daughter and 27 years of age at this time.
I just don't want to spend those $5,500 can this lawyer is asking me for his services, I appreciate very much your replies and my family will too

One of my friend got their Fingerprinting letter and the last name is misspelled. What should they do go ahead and take it to the FP office or call USCIS and get it corrected.

I am happy to write that today I received my first emailed receipt notice for a FY 2010 H-1B application and that then, about 5 hours later, I received an emailed approval notice in the same case. The I-129 was a U.S. Masters Cap case that was premiumed processed with the Vermont Service Center.
I will update this site as I receive word on my other FY 2010 H-1B cap cases.

Any advice is greatly appreciated.
Also I had a question about the employment.
When one graduates from University is he/she eligible to still work for the University while waiting for the OPT?
i.e. graduation date (dec 22) - opt start date (january 17th)
