Dear Friends - I have a question and would appreciate your thoughts.
My father visited us for 6 months and I have a copy of his visa and passport notarized. What are the rest of the formalities (W7 form et al) that I should complete so I get some exemption? Or have my assumptions been wrong?
Yes, you can file him as dependent & you do not need his SSN. You have everything (notarized passport etc.), you have to file for ITIN number with IRS. I know lot of my friends did it (not of their own but they went through tax attorney)

Contact the USCIS Ombudsman's office directly. http://www.dhs.gov/ximgtn/programs/editorial_0497.shtm
If you search online you should be able to find the telephone number for the main switchboard at DHS in Washington and then ask for the ombudsmna's office. You will probably need to submit your problem in writing with supporting documentation. Weve had a problem where USCIS made an error and have been dealing with the ombudsman's office for over a year. Patience is needed and followup on a regular basis. Eventually the problem will be escalated to senir USCIS staff in Washington for resolution. Be tenacious!

I got my GC on 09/18/07. Now my consulting company (how sponsored my GC) is having issues with the client and client is thinking to terminate the contract.
Client want to bring me to there pay roll. In other words they are offering my permanent position.
My consulting company does not have immediate opening for me.
It is not even a month that I got my GC. And I am with the same consulting company for about 6.5 years now.
Please help me. What should I do? If I accept the offer will I get problem at citizenship stage? If I do not accept offer I will loose job and I don't know how much time I have to wait till my consulting company find job for me.
Accept the offer like I am planning to do. Job is most important.

I guess you should be good with your AP . But also there was a thread about one of the IV'ians AP experience at SFO. Please read that so can understand what AP is for and when it can be used as per the IO at SFO airport
I don't think that having AP you can bypass your criminal record. The officer at the POE will have to make the determination if you are eligible or not. I recently read (I don't have the link to back it up) that a Vietnameese lady well in her 40s who had a green card (she was not a citizen) had a drug possession (it was not even possession with intent to sell) conviction and that the officer at the POE told her that she was inadmissible and that she had to go back from where she came.
The only people who are granted entry without any questions irrespective of anything in their background are US citizens. Everyone else can be refused entry at the POE if found inadmissible.
I am not sure if spouse battery qualifies as a deportable offense. If it does, I would expect that there will be problems at the POE on the way back.
Consult your attorney and see what he/ she says. If domestic battery is a deportable offense, even a green card may not help you.

I also got RFE from VSC for AP reg PP clear copies. In my case, lawyer asked to send me clear copies of bigraphic info which means first and last page of PP showing photo and name and other info. I scanned and sent color images to my lawyer. So strange that all VSC people are getting this RFE.
Online status simply shows, recieved and pending.. Does not reflect the RFE at all.

Thanks..I am saying or implying that they broke a Law..I am not an expert in law.. I was just intrigued by what is written on the homepage ""It is discriminatory to have laws that subject immigrants from 4 nations to more backlogs and the resulting hardship from such backlogs."
So from all the replies , it looks like Money is the main issue ( and off course effort & commitment ).
We are having donation drives here right? Need to get inputs from law experts and if they think we have a chance - why not ?

d15...if it is in the budget I would go for the D80 over it's smaller brothers. I like the addition of the larger viewfinder (and the replaceable cover is a big plus imo) and the larger sensor. You may also find the 100 iso setting appealing. I can't say much about the other features Nikon offers and what would be appealing to you as I am a Canon user but I am guessing you've already done lots of homework as you near decision time.
From the little I know about Nikon, It looks like they have a good selection of lenses as you build up your gear. So far as quality of images I can't speak bad of Nikon from what I've seen. You sound like your commited to Nikon and I won't try to change that but I will say the D80 looks better for the extra $$$

Thats not true.. A few days back I read on IV forum itself that around 10K were wasted this year too.
Was it reported from AILA or ombudsman or someone making prediction? A few days ago, USCIS issued a report saying that they approved 60k GCs due to the July fiasco. That should cover all available visa numbers for FY 2007.

10/17/2007: Total of 60,000+ EB-485 Applications Adjudicated During July-August-September by NSC and TSC
* AILA has reported that during the period of July, August, and September 2007, Nebraska Service Center and Texas Service Center adjudicated 60,000 plus EB-485 applications. Since EB visa number was unavailable for the entire EB cases in August, presumedly a substantial portion of these cases could include those cases for which the EB visa numbers were pull out before July 2, 2007 in June and adjudicated throughout the period as reported by some I-485 applicants who reported that their I-485 applications were approved when the visa number was unavailable. Interesting.

Hi,
Me and My friend developed a product, which is ready to launch. The product is very good and two fortune 500companies are willing to implement the product and back us up.
Now my problem is I am on H1B working fulltime with a company and also have an EAD. At this moment I cannot leave my fulltime job. My question is , if I can be a partner with my friend in the new company we are forming( My friend is a US citizen), also will I be able to get paid ( as the developement of the product drained my pocket, this was the hope and I think we are close to reap the hardwork) . Also my wife is also on EAD , can she be the partner? Will there be any issue if I can do that.
Please help!!

Let's get some stats on how many employment-based green card applicants are from the state of California. Perhaps they are printed on a DOS, USCIS web site or report. I am sure the number is high (San Jose etc.)

I went to DMV in NJ with my EAD. They will give you the DL based on your EAD date.
don't worry about the H1 satus. DMV only check the document and enter the number in system. I hope this won't do anything to your satus. As i know.
Since i haven't received my H1 approval, i got to use the EAD in my case.

The idea is good but,
People with EAD will not come. They are out of the troble zone anyways and can use EAD to get a new job easily as EAD is like a greencard.
People not working in financial sector will not come as they do not think it affects them
People from financial sector will also not come as they are busy finding a job
Remaining will also not come as we desis are reluctant to spend money. It costs money to travel. So maybe DC area and nearby area people may come. But they will be handful.
Most people will be ok to do online petition or fax campaign as you just need to press a button.
