FP: Jun 25, 2008
Card prod ordered: July 23, 2008
EB3-I / PD: Mar 2006 / I-485 - RD: Jul 2007
Will post about duration as soon as I get the cards in hand.
I Efiled mine on may 19th, FP on jul 3rd, no update yet.
Efiled my wife's EAD on may 30th, FP on jun 24th, Card prod ordered July 23rd.
We are currently working on EADs which expire on 30th Aug.
Am worried if I will have the card by then or not.
If i dont have the approval by aug 19th, I am planning to take Infopass for the interim EAD.
It sucks to see they dont follow FIFO or atleast close to FIFO, so much variation as some june filers received card in june itself.

One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

Its probably part of an investigation of your employer. Maybe they finally decided that it wasn't necessary to interview you. But probably best to get back to that guy all the same; talk to ICE directly too.

Well, in that case you become a ulta employee and trouble your employer...
NKR, not sure if you heard about this one proverb... "jabh kismath GA***U hai tow kya karey ga PANDU"....we unfortunately get trapped with such type of employers who trouble their employees and learn lessons in hard way and looks like you haven't encountered any such experiences with your employer, if that's the case you are lucky enough & I wish you would NEVER fall into such employers hands who would trouble for so many other different reasons and this could be one way....or not sure if you should have one small experience and see how you feel just for the heck of it....
I can sit here and add as many proverb's here all day long but the point here is try to be supportive to folks who are seeking for some help rather then sharing your "KATARA" proverb's..try to improve your thought process if you can....

That's absolutely right.
I personally think Mr. MPADAPA's assumption is wrong. Last year (2008), the spillover came from Family quota of 2008. Spillover from Family or Employment quota of a particular year cannot be given to the following year. So the fact that there is nothing left from the family quota of 2008 doesn't change any situation here.
So, this year the spillover that Employment category can get from Family quota will be the unused numbers of 2009 Family quota.
This is just my thought!

I think initially due to rush the NSC sent apps to CSC because either the person's residence was in CA or Lawyer, In my case my lawyer is based in LA, CA. But now CSC is trasferring back the 485 apps to NSC where the 140 is being filled (or may be there is some other criteria). I am waiting for the EAD and AP approvals and FP notice.

5. This employer is a consulting company...(desi) & they asked me to sign a financial agreement to repay their expenses on labor substitution/I-140/I-485...if I will leave them early. ...Is it legal to ask for such kind of agreement...?

Asking you to sign an agreement is not illegal. There are employers (even big names) who ask their employees to take care of the expenses for GC processing. The main concern should be to verify if this company practices fraud. The only way to check is either by searching on the web or talking to some other employees who work for this consultant (making sure these employees are also not part of the fraud).
I am sure you have heard about people like Nick Mandalapa who were filing multiple I-140 for the same labor certification . The sad part is that there is no USCIS online system to verify if a labor certification was used to successfullly file I-140/485.
And remember that if there is fraud it can haunt you ater in your life even "AFTER" you get your GC. USCIS can revoke your GC at any time if there is a proof that a fraud has occured in the process.

Sorry, I did not raise my arm to indicate that it was ALL sarcasm. Durbin is aginst H1B. Although his press release says that he is not against green cards, but thats just bull.

I am in a similar situation and have a very simple question. Can I port from EB3 to EB2, while on EAD? I do not have a valid H1. AFAIK porting needs re-filing a labor application, hence the confusion.
