I know after we file the i-485 for 180 days, we can change our jobs. But rule is that the new job should be in the same field as the old one.
Can i change my job from a biological researcher to a biostatistician? My current job is in the field of biology, which involves lots of experiments. If I change my job to a biostatistician, which is like a programmer, do i still qualify the "similar filed" rule? thanks for your help!

WASHINGTON, March 16 � Senator Bill Frist, the Republican leader, introduced a stringent border security bill on Thursday, rejecting pleas from senators in his own party who appealed for more time to finish legislation that would create a guest worker program for foreigners and a legal remedy for millions of illegal immigrants already in the United States.
Mr. Frist said his bill would include several measures already hammered out in negotiations under way in the Senate Judiciary Committee, which had included an increase in the number of border guards, more fencing along the Mexican border and faster deportation of illegal immigrants. But Mr. Frist's bill would not create the temporary worker program that President Bush has urged to legalize the status of the 11 million illegal immigrants thought to be in this country.
"Our country needs security at our borders in order to slow the flow of illegal immigration and make America safer from foreign criminals and terrorists," said Mr. Frist, of Tennessee.
Mr. Frist said he had decided to pre-empt the Judiciary Committee's work to ensure that the Senate meet his goal of holding a vote on immigration the week of March 27. He said the committee's legislation could replace his bill as the starting point for a floor debate if the senators completed their work in time.
The decision put him at odds with Senator Arlen Specter, the Pennsylvania Republican who is chairman of the Judiciary Committee, and highlighted divisions within the Republican Party over immigration.
"I think it is a colossal mistake to take this to the floor," Mr. Specter said early on Thursday. He sounded more conciliatory after meeting with Mr. Frist. Look at the number of people who posted messages to this thread .... even if you say 4 times that number of people posted messages to WhiteHouse.gov it is no where close to the numbers we need .... Lets not kid ourselves - Unless there is a miracle - most of us are looking at aleast another 3-4 year wait :(

I have 14 years of education in india and 20 years of experience in IT - if my job requirement says bachelors equivalent + 10 years experience will it qualify me and job as EB2 ?

This discussion scared me now.
I came in US on 06/03/2001. When I came I was told, no project for me right now and I have to wait. I waited till 09/11/2001 WITHOUT pay.
The first time I was on my company payroll was in 09/11/2001. Since then as of today I am working continously.

It seems that i can file tax using form 4852....but to do if he send legal notice claiming that i have made losses to him worth 25 K....i had good relation with client , gave app notice and also have refe letter from client (received award form client)..........so there shud be no point for liquidation thing and also i have all previous employers emails acepting my receignation and notice period...
If your employer paid taxes on behalf of you , he must have recieved w2.If he doesn't give w2 to you , you can call IRS and request for one , they'll fax/mail it to you.I did it once and filed taxes.
He may be threatening you about legal notice, but I don't think he'll send notice.You can think what to do when recieve a notice.

Guys, please take attorney advise before rushing in to refile. Duplicate applications may create problems for you later on.
Imagine, given the huge retrogression how many countless times we will be refiling our EADs ad APs if we don't act now.
Many people are blissfully enjoying the fruits of labor of some very dedicated IV member who selflessly participated in San Jose rally and flower campaign. These efforts were instrumental in the July visa bulletin reversal. Isn't it time we all stood up for our rights and make a strategic impact through a legislative change rather then just be satisfied with a tactical July visa bulletin reversal win?
I can't talk enough about how vital it is for you to act now. Presidential race will kick in after October/ November time frame. Our window of opportunity is short. Lets help ourselves!

Question 1. How should service centers or district offices process unapproved I-140 petitions that were concurrently filed with I-485 applications that have been pending 180 days in relation to the I-140 portability provisions under �106(c) of AC21?
Answer: If it is discovered that a beneficiary has ported off of an unapproved I-140 and I-485 that has been pending for 180 days or more, the following procedures should be applied:
A. Review the pending I-140 petition to determine if the preponderance of the evidence establishes that the case is approvable or would have been approvable had it been adjudicated within 180 days. If the petition is approvable but for an ability to pay issue or any other issue relating to a time after the filing of the petition, approve the petition on it�s merits. Then adjudicate the adjustment of status application to determine if the new position is the same or similar occupational classification for I-140 portability purposes.
B. If a request for additional evidence (RFE) is necessary to resolve a material issue, other than post-filing issues such as ability to pay, an RFE can be issued to try to resolve the issue. When a response is received, and if the petition is approvable, follow the procedures in part A above
Even as it stands RIGHT NOW without the "New AC21 Rules", you cannot use AC21 unless your I-140 is approved. The basic principle of AC21 is "If your I-140 is APPROVED AND your I-485 application has been pending for more than 180 days" you can switch jobs and not lose anything.

dear members,
dint had much time to go thro' your responses. but if senior ppl are targetting this fellow( mercies) for this thread, then i beg to differ. because as a member of IV, i have been answering "hadron" posts too at immigration portal.
I think all Mercies is trying to do is help IV out, by preparing answers of such questions which stupid ppl ask, so they can be put to a stop right away. Probably he's drawing your attention to some q's that all of you have answers for, just guide mercies to that post,
but i think all of your remarks have been directed towards merices only as if he's started it all.
i guess we outta stop ppl who are trying to defame this collective effort by giving them one-point answers.
have to get back to work.

Really good point.
Everybody say that the 90 % of the american are against illegal, i don`t know, but it look really strange to me, due that everybody use illegal to clean the house or delivery food. I really think that american people are scared about high skilled immigrants that can really harm their job, i feel it everyday in my office. That is reason for my pessimisme. Nobody cares about an housekeeper or a delivery guy, no americans what to do that. By the way, my friends, from England, got a green card in two years. How could it possible?
