One of the major network today showed someone (representing the regular US citizen) getting doused with gasoline and the host holding a match: a view of the government's intent to legalize illegals, burning the job-less citizen.
We must respect such feelings - in my country of origin a lot of us never approved of illegal immigration en mass from neighboring countries.
Question is: we the people - who have LEGALLY established roots the way America wanted: Can we brought out from the sun into some sort of shade?
How can we ask this through IV, with factual quantification of our woes, in a way that All Americans can empathize with?
Facebook is a Great start - we need to take it to the next step.
Also, is it possible to buy (through contribution) an ad segment on a Washington Newspaper? TV and internet maybe more expensive.
Drastic indeed - needs money, but swift and possibly more effective.

Without legislative or administrative reform, EB3-India would be reduced merely to a mechanism which folks would use to extend their H1Bs indefinitely on the basis of the underlying I-140, or a means to lock a priority date while they plan their strategy for an EB-2 petition for a PD port in the future. As some analysts have predicted, EB3-India wait times might get extended to decades without some sort of reform. Not to make light of the situation, but for an EB3-I applicant with a recent PD, the odds of getting a green card through a US-born child (once they turn 21) could become greater than through their own EB application.
"interfiling" to use old EB3 PD for new EB2 is not the easiest path for EB3-I guys specially if they have used AC21 and work on EAD now ( Most of us are in this category). Priority date porting is not an issue, USCIS does not have a problem with that. The problem is with "Job definition and level". While one use AC21 claims job position matching EB3 job classification and if there no enough progression gap between AC21 usage and "inerfiling" It becomes hard for a lawyer to convince USCIS that fellow is matching EB2 capability under same job classification. Hundred of such intefilings are waiting without no action from USCIS. My lawyer's advice wait till we logically can establish the skill progression, in other words minimum 3 years of wait from the day AC21 usage. And other important thing is "real promotion" in position should happen at employment and this whole explanation is based on assumption of employment at the same employer. If you change employment inbetween after AC21 usage and before interfiling , your 3 years wait cycle starts from new emploment date. I have not filed "interfiling" just because of these reasons and waiting for correct time to do that. In other words Eb3-I is really and badly screwed.

If these individuals are a security threat, we must know that sooner rather than later.�

Guys do not feed the freeloaders by telling anything you are reading in the donor forum. Let these people help themselves by signing up for recurring contributions if they want helpful nformation about their EB2 PD movemement. We are still not meeting of our advocacy day amount. It is all because most people want free lunches. This needs to stop. The 200 people going to DC tomorrow are going to speak for you and me for yours and mine greencard. They are taking time off and spending own money for you and me. Nothing is free in this world. IV is also doing this for you and me and we are taking it for granted. Let people do some good deed today if they want to know good information

Either employers think EAD is the student EAD which needs to be converted to H1 or they are ignorant.
My suggestion would be to not bring it up....and if it does come up tell the employer that you have work authorization and that the employer doesn't need to do anything. If that doesn't work, then someone is actively discriminating...

Hi,
My labor (EB3) and 140 were approved a while ago.My company has sent H1B extension for three years in Feb 07.There was a query requesting for additional evidence from USICS in Apr 07.They are requesting lot of my company info and nothing about myself.My Company is taking its own sweet time to respond.Now I am eligible to file 485 as per the latest June visa dates for EB3.My question is could I file 485 when H1b extension is pending.My previous I94 expired on May 07.Please help as it is urgent.If the visa dates move back again then it will be horrible.My Company didn't file during concurrent filing and has eaten 2 years of my life and now they may use this to further hold me..any help will be appreciated.

The report also says that nobody knows how many of those cases involve illegal immigrants." (Emphasis ours). This exchange then ensues:

Will you guys stop this madness atleast now?. If US started bending rules for people who send flowers, then everyone will try to manipulate the system. There is a lot of difference between the circumstances of originla gandhigiri and now. :rolleyes: That was our country back then, for crying out loud.We are in a foriegn country and the issuance of visa a previlege not a right.Why cant you guys understand this simple fact?. Please don't give much credence to 'conspiracy theory' posts by paranoid folks like H1bmajdoor who live in fear of their own shadows. Neither do they understand the difference between a law AC21 and regulations ( USCIS frames these) nor do they care to learn. Their ignorance causes them fear, and fear causes them to act irrationally.

Hey Bharatpremi, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
assume eb1 demand = 5000, eb2 demand = 20000
we can easily see eb2 getting completely approved.

let's compile a list of famous immigrants like Albert Einstien, Henry Kissinger, Madalene Albright et al and change the face of what constitutes a legal immigrant. We need stories of doctors, scientists, engineers (the success of NASA) who were immigrants and benefited this country. That way we can fight the image of the immigrant as a low wage seeking will work for food kind of a worker being created by anti immigrants. Let Lou Dobbs fight history and deny it.

What should be the answer to this question on I-485 part 2- out of following 2 options for my dependents ? to me it seems #b is the right answer for my family members 485 and #a for me. BUt some how teh legal guys are changing this from #b to #a for my dependents!!
