For stamping you should not need pay stubs to prove your staus. Uninterrupted pay stubs are very important for change of status when you are applying while in US. When you leave US you dont have a status, the visa officer should not base his decision on the continuity of pay stubs. I went through a very similar situation, my change of satus was denied even though I was on genuine unpaid leave. However I ended up leaving the country and getting H1B stamped in India with no problems.

To everyone who reads my post. I apologize for not being clear. The article says that they are talking about eliminating the per country caps and giving green cards to STEM graduates. In my haste and excitement I should have spelled this out. Now with that said I do not appreciate the snide remark from the previous poster. This is a forum for productive discussion, not for people to be condescending. So let us rejoice that maybe people are listening to us!

2. check the instruction here: http://www.uscis.gov/files/form/I-765instr.pdf
3. You must send following documents.
- Copy of i485 receipt.
- EAD card front & back.
- 2 personal photos.
- Check on US Department of Homeland security for $340 (based on filing date original I765).

when situation is urgent - JUST GO !!!! - remember life is short and there is life beyond US too ..also --consult a lawyer ..don't rely on free advice ..most likely you should be o.k. but many out here are on EAD's and H1 rules keep changing.
my feeling is if you still have valid job (even though you had some unpaid) ..you should be o.k. . but lately there have been horror stories of harrasment ...so in the end prepare for worst and hope for best

I've found this site to be very helpful so far and would like to ask for some opinions on my case.
My I-485 (EB2) was submitted in 2007 and the PD is approaching, only 5 days away based on June's VB. My girlfriend is currently with F-1 visa and we are planning on getting married asap so that she can submit her 485 before my case is approved.
Here's the complete list that I can think of based on the research that I've done.
Documents that my future wife's need prepare
I-485 form
birth certificate
marriage certificate
medical exam
passport pages (I-94 card ect)
I-20 form
Two photos
Documents that I need prepare
My I-485 receipt
????

My mother-in-law would like to get visitor visa.
How do I answer #37 of the DS-156?
The applicant's (my mother-in-law) son( my husband) is in the U.S. illegally. I am US cit. and my husband needs to report to visa interview within the next year. We have been post-poning due to medical issues. In the meanwhile we hope my mother-in-law can come here to visit her granddaughter.( I am unable to travel). #37 of the DS-156 asks if any body is in US. We should answer YES, because her son is here, BUT, what do we put for his status? Illegal? I read one article that stated to mark YES only if he has legal status. I do not want to put NO, immigration already knows he is here and we do not want to be dishonest.
Any ideas?

Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved. I would advise a consultation with a good attorney, this is a very important matter for you. Some attorney's will answer an initial question free on the web- gives you some preliminary info.

I have just gone thru March recording of IV lawyer call and the below caught my attention. Ms Susan mentioned that any company name change after I140 approval has to refile I 140. I am utterly confused as that particular scenario affect me and i would like to know what best course of action i can take at this point.
I filed LC and I 140 with company A
My I 140 got approved
Before i filed my I 485 my company changed its name
I asked my attorney at that time if we need to take any special action
Attorney said they can just add an amendment while applying for I 485 about name change and apply with approved I 140, which is with old company name.
I and my wife work on EAD for past 3 years and i am still employed with same company. I wonder which one of above attorney is correct and what i should do.
Does the fact that my I485 is pending for more than 180 days after approval of my I 140 will come to rescue in case of question about company name change (AC21)
