Reliable information from my friend's lawyer says that the cap for this year is NOT reached in the 1st one week. I think this means all applications filed in first week will be processed.

I have a masters degree (MCA) but the job does not require a masters when I joined. I have my bachelors (both 3yr degrees from India). I have close to 10 years of professional experience.

The court is saying that since this is a non-binding memo; the court does not need to judge whether or not the USCIS definition of an employer employee relationship is valid or not.
It just means that H1B petitions that have denied based on the 'control' issue can be appealed presumably. But this might only be an option for large IT companies; which is probably what the USCIS knew and planned for all along. I think the goal of the USCIS is to apply this memo selectively against the smaller Desi consultancies.

I'm sure the following questions have been asked several times too. What are the answers in the following scenarios:
After 485 filing and before 180 days:
- Person loses job and is unemployed. Does the 485 stage continue? Does AP and EAD assigned to this person still continue to work?
- If this person finds another job (based on EAD or H1), does the 485 process continue? Or does the whole GC process needs to restart?

Check out data for China. It shows significant reduction from last month. Expectations are low for India but China will advance a lot in July.
This is done in preparation for the spill over (fall down); they have used up all of "china's own" numbers and now they will actually retrogress EB2 China (to move it along with EB2 India) to distribute spillover (fall down); the VB will come with a "long explanation" as to why the retrogression for EB2 China despite of low demand....

Unless it is an expired "conditional status" card, your legal status in the US in no way changes. Only the card expires and not your legal LPR status! I don't quite understand what your "mistake on birthday" comment is all about!
You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.

Actually, you're no longer in H-1B status. If you end up getting another employer to sponsor you and you're RFE'd for your last 3 months of pay stubs to show your last day of work and it shows you entered the country after that date as an H-1B you will be denied your visa at the consulate.

SSN is not really a requirement to start to work. So the answer to your question is NO, she dont need SSN to work on EAD.
But in a practical scenario she need an SSN to work (see below reasons).
SSN is required to pay/withhold taxes and probably for pre-employment background checks and all. So it is very unlikely that an employer will hire somebody without an SSN (or at-least applied for SSN).

Yes. This can be done when applying for I-485. I don't know why, but couple of lawyers I spoke with, recommended this route.

I filed my AP on April 29th,2008. I had one LUD on July 8th , the status was case pending and another one today,today status changed to

On July 10, 2008 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service.
Any idea what does this mean? Is it approved or something else.

I have a approved H1b from company A. Company A also shared a copy of approval. I was never counted under H1b cap before this approval. If I now decide not to join company A and assuming company A will not cancel H1b, can I use this H1b to join another company B later using H1b transfer�???? I am presently on cap except H1b and need a cap subject H1b in order to move to any private firm. So approval from company A matters a lot to me.

I am currently unemployed and my spouse needs to travel to Mumbai urgently. Our AP is valid through November 30, 2009. Will there be any issues for my wife when she comes back - possibly because of my current status. Wife is employed (with a different company)& the EAD/AP was filed by my last employer. Responses will be appreciated. Thanks!
She will not have any issues in entering as long as her 485 is pending. Make sure, she gets back before the AP expires.

You need to carry both passports. The VISAs on the older passport remain valid unless they were explicitly voided.

If I have an approved labor and switch attorneys, is it mandatory for current attorney to hand over the approved labor and all relevant documents to the new attorney or can he choose NOT to give it ?
Just wanted to run it by you guys and seek your views on it. I do know that the LC is employer's property .

having valid AP at any time, even though is not a legal requirement, is a necessity due to potential emergency travel to home country or any other country. Hence it is safe to reapply AP 2-3 months before expiry and EAD 3-4 months before expiry. This will give you peace of mind.
