Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).
Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

U are saying - The person's GC category should be same all through out the GC process, irrespective of the technical advancements the person make during the course of the GC process. A person is porting only because he is qualified for the category, U folks are talking as if there is an open slot and everyone is clamoring for it.
U'r logic should be similar to the below scenario..
A person joins a company as a Jr. Engineer, then based on U'r logic he/she cannot become a Manager (which requires an MBA / equivalent) because he entered the workforce as a Jr. Engg. Even though the fellow would've acquired necessary skills and even MBA (going part-time to school), still he/she cannot become a Manager. U are vouching that an MBA who joined few months earlier can become the Manager but not the home groomed fellow. Wow, U'r logic seems to a ground breaking thought process, please extrapolate U'r lawsuit for the case mentioned above. If you win, this might be the most ground breaking decision in US.
Personally I've reported to folks who joined company as high-school grads and worked their way up to Managerial position ofcoz acquiring the necessary college education while working. They have shown up those experience to move ahead of other folks who joined later with higher degrees.

My priority Date is EB2 May 2006. I will be current if the dates got moved.
I will be out of the country for the entire month of May.
Please let me know if it is acceptable to be out of the country during 485 approval.
Also please let me know what I need to do at the port of entry.
May not be acceptable. As soon as your dates become current, I guess you will be eligible to file for 485 on May 1st. and you must.
Come June 1st and if they retrogress, for some reason, you will miss it.

My receipt date is June 20 and my PD is Oct 2002. If the July visa bulletin does retrogress, will I still be affected with regards to I-765?
No. Since USCIS accepted your application when your PD was current, then you are fine.

I think this is very well said. As much as I'd want the predictions to come true, somehow I sense the same observation as below. It appears this has been said in the past, but all we see is very little movement. Secondly, as I recall, DOS had hinted that there'll be advance for EB2 India, I don't know if they mentioned EB2 China? Has anyone seen DOS themselves talking about EB2 C? The reason I am raising this here, is that maybe when DOS had said "substantial movement for EB2 India", did they mean that India will move to China's date (From May to Jul 06, 3 months movement)?

Call the place where you've ordered flowers and ask for a refund if flowers are delivered elsewhere. It should be up to USCIS to recieve and then ship those flowers to the hospitals.

The OP is great. He has created a new id to discuss L1 fraud. Will he be creating one id per issue... recapture, H1B abuse, outsourcing, backlogs?? wow!!!
Not sure why he wants his/ her identity covered up. This shows how good some of us are in trying to make noises in the dark and not doing anything about issues in hand.
In all, I still don't understand why L1Bs cannot work at Client site. I am sure that the L1 petitions specifically ask for Client site / work location. If Client site address is mentioned, the USCIS does approve the petition. If it is against law, they will not approve the petition. I know this for a fact since some of my friends are on L1.
Regarding my identity cover up... I have mentioned couple of times abt the seriouness of the situation as the other party is a multi billion dollar organisation, second please add all the reasons why ICE/USCIS/DOL provides anonymity and whitsle bowler protection to people who brings these kind of violations to their notice.
Regarding working at client site... Yes they do get approved for working at client sites BUT with the condition that they would be working directly under the suprevision of their managers and NOT the client managers (they don't qualify for consulting assignments). Also these L-1B visas are approved for working on speciality skills NOT on common technical skills (like java/.net/DBs/Prod Support etc). Next time read your friends L-1B petition carefully and you could find all these details over there.. also verify the L1 reform act of 2004 (published in this thread).
Regarding retrogression... I agree that L-1B visas are not impacting the same much and also I think if someone in L-1A LEGALLY qualifies for EB-1 there is nothing wrong in getting the GC, If we think thats not appropriate then we should bring this upto the law makers and get it rectified BUT fake EB1s should be notified to authorities.
We are fighting against a fraudulant activity by which our jobs (and hence our GCs) are jeopardized and its not a fight against fellow immigrant BUT a fight against the greed of these corporates to make money even by committing such fraudulant activities.. hope this clears the doubt.

I heard that we have to provide all the address where we stayed in USA for filing I485. But very first time I came to USA almost 6-7 years back for short term and I do not remeber the actual address. Basically i do not remeber very first two address when I came here for short term. Is it a matter of concern.

Yes it is a concern that I have to address. However I see 2 ways to work around it.
1. Travel out of country get H4 stamping done based on my current H1B status
or
2. I apply for I-485 and add my wife later to the application when we have received her H4. In this case, once I have applied, I can add my wife to the application even if the dates are not current at that time.
If I were you and my priority dates were current, I would go for 1 above [get H-4 stamped ASAP and enter in US and apply for I-485].

We heard so many stories about violation many Indian bodyshoppers like bench without pay,Low pay ,fake resumes and many more. But when any bill comes to control them we are opposing. Because we fear that we may be one of the persons working in those companies and may be impacted by that.
Certainly the bill is not a pro immigrant and anti immigrant bill. But some kind of restriction is needed to clean out H1b. I accept as a pro immigrant we have to oppose any anti immigrant bill. So I am sure IV will try to block the bill as they did the restriction in TARP.
I am not going to get any benefit if they shut the door behind me. I need just one job that I can get any time and whatever compettion and there is no need to shut thousands of people. So my views are not based on any personal ambition.
I am seeing some positives in the bill. Wages will increase for the H1bs also. Only genuine companies can do the business. Best and bright people will not be impacted by this. Also it can open opportunity to increase H1b Cap and Green card Cap. So there is a good possiblity to reduce or eliminate retrogession.
Basically there are two options for IV and other pro immigrants if the bill is considered serously. One is just oppose the bill and try to block completely. Or other option is to negotiate to include our agenda to recapture/increase GC and also to modify the portions of bill. Instead of failing with option 1 getting success in option 2 is better.
I think this bill will not be passed if it is against WTO trade regulations.
So you never know all these violation when you were in H1. What were you doing then. Why didnt you oppose then. If you know the violation did you call the USCIS and DOL and complain...No. Because you would end up in trouble. Now you got your GC and no matter if other guys are end up in trouble, in fact it would be helpful for you... Are you ready to review your status thorught all your H1, all your PREM processing to prove there is no violation...? Eveyone know how things are working. So if you got your GC just keep quite and move on. When you can not be helpful to others...why you are just creating pain.
If you are worrying about the wages..let them free the employees from employer. Thats the best way to clean up the system. If you are really pro-immigrant your thoughts should align in that direction. But most of us see you as Ron Diamond in the making. Its very unfortunate. One study shows that only immigrants opposing immigration more than natvie people.

Looks like they do not publish the e-mail address to contact congressman. You can send e-mail only through contact your rep system where you can send only to your local rep. If your ZIP code does not match the congressman's district, then you cannot send him the mail. Even to Judiciary committee chairman !!!!!!!!!!!
The only alternative is to send fax. I don't know how I can send so many faxes when I don't have fax at my home.

At last, after 10.5 years, 4 employers, 2 Labor filings, 1 Perm and 2 -I 140 (One from my employer and one from my spouse employer),1 - I485 filing, 2 SR, 1 senator request, 1 infopass - Got the mail - CARD PRODUCTION ORDERED for self, spouse and son.
What to do now? I dont know, for the last many years, used to think everyday about this 'CARD' and now nothing else to think about. May be, I should start thinnking about ????
But for now, Just going to relax and savor the moment.

I have a question regarding the I-693 Medical exam. it was mentioned that you will need to take a vaccine for MMR, Varicella, Tetanus and Hapatitis B. it was also mentioned that they will do a tb test and a blood test for HIV and syphilis. are these all the vaccinations and blood tests required or are there aother blood test required in addition to these??

Below are the list that I have from my lawyer to prepare my I-485 :
1. for Evidence of status you need a Copy of Last Entry I-94
non immigrant arrival/departure record, showing your admission
to the US and current status. (Front and back, make sure the date is
clear to see)
2. To show that you are always in status while you are in US you will need
Copies of all immigration related documents from USCIS
(such as I-20, OPT, H1B, H4 approval notice, or other status)
3. Copy of Birth Certificate
(need translate & notarize if not in English)
4. Copy of Marriage Certificate if you are married
(need translate & notarize if not in English)
5. Copy of Passport pages with non immigrant visa
(including all passports you have used since the last entry you need to
copy all the stamp you had on the passport. Again this is to show the
last time your in you US and to make sure you are always in status)
6. I-693 (Medical Exam)
(You can dial 1-800-375-5283 to choose the physician list)
you will required to show a proof that you have take MMR, Varicella, Tetanus and hepatitis B
if you can't show any proof they will required you to take it on their office and it will cause you quite a lot money ( you can take
the vaccine earlier on your family/ regular dr. office and could get covered by you insurance) it could save you $300 per person.
the mandatory test you have to take at their office is tb test, blood test
for HIV and syphilis and regular phisical test. once you have all vaccine
and the mandatory test they should gave you the seal envelope to send to USCIS along with your other document and they will give you a copy as well.
7. If you apply for your family member you will need
I-134 (Affidavit of Support) stamp by Notary for each family member
8. Employment Verification Letter
Employement letter on the letter head of the petitioning employer
which confirms that the job on which visa petition is based is still
available to you. The letter must also state the salary that will be paid.
9 . Photos (2*2 color front-view passport photos)
*2 for each I-485, additional 2 for each I-131,
additional 2 for each I-765
10 Fee Payment made to USCIS (1 per applicant)
$325 for each I-485 filing fee
$70 for each Fingerprint fee
$170 for each I-131 filing fee (if apply for Advance Parole)
$180 for each I-765 filing fee (if apply for Employment Authorization) .
Hope this list is help for those who is ready preparing their document.

Below are the list that I have from my lawyer to prepare my I-485 :
1. for Evidence of status you need a Copy of Last Entry I-94
non immigrant arrival/departure record, showing your admission
to the US and current status. (Front and back, make sure the date is
clear to see)
2. To show that you are always in status while you are in US you will need
Copies of all immigration related documents from USCIS
(such as I-20, OPT, H1B, H4 approval notice, or other status)
3. Copy of Birth Certificate
(need translate & notarize if not in English)
4. Copy of Marriage Certificate if you are married
(need translate & notarize if not in English)
5. Copy of Passport pages with non immigrant visa
(including all passports you have used since the last entry you need to
copy all the stamp you had on the passport. Again this is to show the
last time your in you US and to make sure you are always in status)
6. I-693 (Medical Exam)
(You can dial 1-800-375-5283 to choose the physician list)
you will required to show a proof that you have take MMR, Varicella, Tetanus and hepatitis B
if you can't show any proof they will required you to take it on their office and it will cause you quite a lot money ( you can take
the vaccine earlier on your family/ regular dr. office and could get covered by you insurance) it could save you $300 per person.
the mandatory test you have to take at their office is tb test, blood test
for HIV and syphilis and regular phisical test. once you have all vaccine
and the mandatory test they should gave you the seal envelope to send to USCIS along with your other document and they will give you a copy as well.
7. If you apply for your family member you will need
I-134 (Affidavit of Support) stamp by Notary for each family member
8. Employment Verification Letter
Employement letter on the letter head of the petitioning employer
which confirms that the job on which visa petition is based is still
available to you. The letter must also state the salary that will be paid.
9 . Photos (2*2 color front-view passport photos)
*2 for each I-485, additional 2 for each I-131,
additional 2 for each I-765
10 Fee Payment made to USCIS (1 per applicant)
$325 for each I-485 filing fee
$70 for each Fingerprint fee
$170 for each I-131 filing fee (if apply for Advance Parole)
$180 for each I-765 filing fee (if apply for Employment Authorization) .

Well its been three and half weeks and waiting.. I am loosing it now. I dont understand what takes them this long to look at a file and put it into this database?
