Here we go again. When Obama's Democratic Party controlled the House and Senate, Congress failed to pass an immigration bill that would have provided a path to Residency and later Citizenship for some illegal immigrants who entered America as children. The DREAM Act died in the Senate in December due to a Republican filibuster.
With Republicans now controlling the House and holding a stronger minority in the Senate, the chances for any comprehensive immigration reform are considered non-existent.
Obama travels to Texas on Tuesday to make the case that his administration has worked hard to secure the border and the time has come for Congress to deal with the 10.8 million people already in the U.S. illegally.
He will also argue that those who care about this issue need to step up pressure on Congress to act, a point he has made privately in a string of meetings with business executives, evangelical leaders and Hispanic celebrities.
Many activists blame the White House for not making the issue more of a priority, and Tuesday's speech is an effort, in part, to shift attention to Republicans who are blocking action.
Many Republicans and some Democrats oppose the measures Mr. Obama favors that would create a path to citizenship for some people who entered the country illegally, saying it would reward law-breaking. Opponents also say not enough has been done to secure the border with Mexico. The White House says it has put more "boots on the ground" along the southwest border than ever before and has cracked down on employers who hire undocumented workers.
The administration has also deported a record number of illegal immigrants, a point that has angered Hispanic activists. Federal officials say deportations of illegal immigrants hit a record 392,000 in fiscal year 2010.

Hi- My stamping on my passport expired on Sep'2008 (over 19 months now). But, my I-797 is valid till Aug'2012. I plan to get my visa re-stamping done when I go to India in May'10.
1. Will there be any issues?
2. What am I supposed to say for this question in the visa application website?
"Are you applying for the same class of visa which is currently valid or has expired within the past 12 months?*" (YES/NO)
The VFS website says the following:
"The following applicants do NOT qualify for appointments in the visa renewal category:
Applicants who have a U.S. visa that expired more than 12 months ago.
"

Hello everyone and thank you IV for all your great work. Much appreciated.
I have a (hopefully ) simple question:
I am EB2 (had been current the whole time) and I am just now ready to file my I-140 and I-485.
That said and considering the now new window to file (till 8/17), should I premium process the I-140? Does it even matter? Am I going to basically throw away $1000?
I had ready that they would not even touch the I-485 till the I-140 was approved but that sounds like a contradiction to concurrent filing, right?
Any info, tips would be greatly appreciated.
My attorney is ready to file but I want to make sure I ask the right questions/get the right info from them before they do so.

If you are questioned on educational equivalence of the 3+2 year degree's parity with US' 4+2 year bachelor + masters, and your education evaluator can make a strong case for it, you should be ok.

485 filed 1 year back and have been working with the GC sponsoring employer since then ( on H1, did not use EAD).
Employer is not going to revoke approved I-140 even if i change Job/H1.
Now, can i use Advance Parole to travel while working for the new employer on a new H1?
Your inputs are highly appreciated.

No need I-485 receipt.. I came on AP they didn't asked the receipts of I-485
even if they ask the copies are enough.

I believe my situation is a lot similar to man-woman-and-gc except maybe that I am single. This is what I have achieved so far after sticking to Company A for 4.5 years (this one was pretty big in size; so didn't have to worry about any paperwork):
1) I-140 approved in August 2008 (total of 198 days till date i.e. March 5th 2009)
2) I-485 pending since July 2007 (USCIS receipt date of September 29 2007)
3) EAD valid till October 2010
4) H1-B valid till October 2010
5) PD: Feb 2007
However as a preemptive measure against any potential layoff from company A, I have started looking around. I am preparing a checklist of things that I have to inform the other companies (say company B) so that the transition is smooth. The 2 main things I can think of to talk about with any potential employer are:
1) I DEFINITELY want to maintain my H1-B; so they will have to transfer it. I will be pushing this to make sure I have the flexibility to get a dependent at any time
2) They will have to help me MAINTAIN my GC process. For example any minor changes in the position requirements to show that the job is similar or same. Thats one reason I am primarily looking at similar work profiles
I would GREATLY appreciate if someone from this thread can point me to any location or list out the things that I should be extremely careful about or notify to both my previous employer and the future employer to avoid any future pains in my GC process. A few things that I remember are as follows, but please provide more information that may be missed out here:
1) Do I have to ask Company B to apply for anything relating to my GC? I want to make sure that they know and agree to all costs associated with the paperwork? Dont want to end up paying from my pocket as I have heard in a few cases before
2) I believe since my I-140 is approved for more than 180 days or actually my I-485 being filed for more than 180 days, I am allowed to move, correct?
3) Since my I-140 is approved and I have an EAD, can USCIS/Company A cause it to be revoked? OR it doesn't apply to my case?

You should be good if the University (UNVA?) is currently unaccredited and has a future chance of accreditation. USCIS might be more lenient for a SEVIS registered school and approved to operate in the state by the respective state education board. Consult an attorney for legal advise.

My lawywer mentioned that they could file Monday July 2nd for packet delivery on Tuesday July 3rd. What is the definitnion of the filing date? Is it done electronically so that the filing date is Monday (the date the packet is sent) and delivery date is Tuesday? Or is the delivered date the filing date.

Two I140 in process with a difference of one years in the priority date (one original and one recently filled substitution with improved PD). Which I-140 should be used for I485. IF PD goes back to retrogration, the substitution would help with a risk of getting reject as well. The original I140 has less risk but if PD goes in retrogration, it might get years to get I-485 approve. Suggestions?

Last year, When I filed I-485/EAD/AP, I wrote the check in favor of DHS (abbreviated) and it was accepted.
