    Its not that I think I am smarter or have any additional insight...but I take things at face value. Of course the total number of pending cases in the chart and in the PDF should match - they both are exactly what they say they are "PENDING EMPLOYMENT BASED I-485 cases" If that's what the report title says, that's exactly what it means. No point in over-analyzing if this is just for pre-adjudicated or only primary applications etc....

    I say stupid questions because people still ask "Does the PDF report contain numbers for dependents or only for primary applicants" - so you are telling me that this is not clear from the PDF report??

    I and many others do not see the definition of "Pending" what is in our minds matching the definition of "Pending" by USCIS. We believe that it is not yet concluded. Even USCIS itself is not clear. In trend chart under "All other pending" its total figure for national level is 279031 till July 2009. Where as in the Excel worksheet it is 233816 till July 2009( Worksheet is produced for the time period till the December 2009 but for July to Dec 2009 all visa categories have zero value thus data is till July 2009)

    So I would request you to keep patience till we get "authentic" feedback from somebody. Many people are working on this in background. If you want to see the signs they are there in many other threads including recently declared FOIA and USCIS data comparison thread published by Pappu.

    We can't be just "innocently simple minded" when USCIS itself publishes different data sets at different links and start believing the only data of a particular worksheet is correct just because USCIS declared it. If you try to compare both of these trend chart and excel worksheet with the April operating performance report declared by USCIS (needhelp! has posted it on this thread) then you get into more confusion and start seeing clear discrepency.

    So choice is yours , patiently watching the input of others on this thread and start contributing in analysis OR keep on doing what you are doing unnecessarily.

    Ask yourself a simple question:

    Is the ITIN Number the same as the SSN?

    Sometimes we read too much into these forms, and I too am guilty of doing the same.

    Take the case of filing the affidavit of support - I-134, I-864. So much debate, but no clear answer.

    Or the case of copying all the pages of your passport - as if the USCIS doesn't have enough documents to sift through

    Or the case of color copies of visas, passports

    Or the case of providing copies all the I-94's you have had till date

    Or the case of providing tax returns, w2s etc

    As per the instructions, none of these documents are required.

    Just go by what is in the instructions, read the questions in the form carefully and answer them honestly, to the best of your knowledge and ability.

    If the USCIS needs more information, they will write to you.

    I left the SSN for my wife blank in I-765
    My attorney told me to fill in ITIN # if available.
    My wife is on H4 and she do have ITIN#.
    I am confused.
    Can anybody please clarify.

    I received a similar response to the 2nd SR. I was told that my case was under additional review and to allow them 60 days. However, my wife's case had been assigned to an officer for review.

    Did you send an email to TSC.Ncscfollowup@dhs.gov (for TSC - another email for NSC). I had no clue where my application was when even 2006 cases were getting approved. I am seeing some movement after emailing them.

    I received a SR reply in mail that my case is under additional review . MY pd is sep 05 and i am so frustrated. They also asked to check back after 4 - 9 months. Is there any body in that situation and what else can be done .. please advice..

    Folks,
    I got a call from the Ombudsman Office today morning was told that my case is in "transit". When is asked her what it means she told it is going to be reviewed by an IO. I got the similar response to my SR that "your case is pending adjudication by IO" so don't know what to make out of it in the sense that its been removed from the shelf and sitting in some pile and IO will get to it when he/she can?

    Did any one get their GC approved after their case was in transit? How long did it take?

    Appt. date: Dec 20th, 2007
    Received the PP by express mail on Dec 21st, 2007
    Mumbai Consulate did not interview husband and myself. An Indian gentleman called us to the counter and told us that the VO had approved our H1B renewals and that we would receive the PP by courier the following day.

    This is really good news.. Can you please provide more details of your case?

    - was it first H1/H4 stamping or renewal?
    - do you have I140/I-485 application filed?
    - did your employer do anything to inform the US consulate in advance about visa stamping?

    Hi GC ON DEMAND, I think you are right... Looks like we did not receive any spill over from EB1 and EB2 ROW --- Here are the calcs...

    Regular EB2 ROW gets 34,436 -- see below for break down

    We know that EB2 gets 140,000 * 28.6% of visas which is 40,040.
    Out of 40,040, 7% is allocated to china and an other 7% goes to India.
    So EB2 ROW = 40,040 - 2*(40,040*7%) = 34,436 -------------------------------------------- (1)

    In the document that you have, EB2 ROW received 27, 406 visas... How? see below

    Total allocation for Eb2 (A1) - 53,872
    India received (B1) - 19,961
    China's received (C1) - 6,505
    -------------------------------------------------
    EB2 (ROW) net = A1-(B1+C1) = 27,406 -------------------------------------------------------- (2)
    --------------------------------------------------

    EB2 (I&C) Regular quota {2*(40,040*7%)} = 5,604 -------------------------------------------(3)

    (1) - (2) - (3) gives the spill over from EB2 ROW to EB2 (I&C), which is 1,426

    Which means EB2 ROW to EB2 I&C spill over is mere 1,426 ???? Hope we are wrong... this looks scary...


    The calculation looks incorrect.

    You considered the I+ C allocations and subtracted those in line 1. You again subtracted those in your final calculation.

    The straight forward calculation is EB2 ROW is entitled to 34,436 (1) and they used 27,406 (2). So splillover was around 7 K.

The United States benefits from our ability to attract and retain needed immigrant and non-immigrant students and workers, and it is important that America remains competitive in attracting talented foreign nationals."

    I appeal to you, Mr. President, to facilitate the retention of the best and brightest from around the world by executing the following administrative fixes as an immediate interim measure:

    • Recapture administratively the unused visas for permanent residency to fulfill the congressional mandate of 140,000 green cards per year.

    • Revise the administrative definition of "same or similar" to allow slight additional job flexibility for legal immigrants awaiting adjudication of adjustment of status (I-485) petitions.

    • Allow filing of Adjustment of Status (Form I-485) when a visa number is not available.

    • Implement the existing interim rule to allow issuance of multi-year Employment Authorization Documents (EAD) and Advance Parole.

    • Allow visa revalidation in the United States.

    • Reinstate premium processing of Immigrant Petitions.

    I am only one among over 500000 highly skilled immigrants represented by Immigration Voice, and we are all counting on you to give us this much needed breathing room while we wait in line to live our American dream.

    We should all feel proud that many co-sponsors are a result of efforts of IV and its members.When members ask proof of success, this is one of them.
    Well done IV for the work so far - but we have to continue this push. Any idea on which other members we should call.

    Note: I spoke with a few members to encourage them to call, there seems some confusion in their understanding of which congressmen we should call first. Calling the current co-sponsors may not be necessary but calling other members might still result in adding more co-sponsors (if we are able to convince them).

    Friends, October bulletin is out and we are again seeing the retrogession. So forget about the talk that all dates will become current - it wont happen unless there is a change in law and past visa numbers are recaptured. This bill is our biggest and only hope until for atleast another year. Lets do our part and hope for the best (believe me - all it takes is less than an hour of your time).

    Chennai , Jan 27th, H1B renewal (applied in early 2006) still waiting..

    by the way those who got the pp back did you get an apology? or did our friends from the other time zone certify that you have been closely examined and are not a fraud/threat?

    Well, I guess what they want us to do is not worry about all this stuff .. just take 50/100 jobs and not come back :) im fine with that just let me know..

    Folks, got Decision email on 09/03, Approval email on 09/08. Does anyone how long does it take to get the CPO email and the actual card from here on?

    Never got the CPO email but who cares? :-)

    Got the cards in the mail today! F*** 10 years of wait is over! Not sure if it was worth it but at least its over now!

    Yes I had one pending and no RFE was received for either. My lawyer is expecting a notification from USCIS stating the second one is withdrawn.

    congratulations! So you had the second I-485 still pending when teh first one got approved? Did you get any RFE about it from USCIS or were you asked to withdraw one of the petitions?

    Will it be helpful to have an InfoPass appointment ? has anybody tried that..

    My case was filed on JUly 2nd, I-140 approved at TSC, No RN, No CC, nothing.. frustrating.. everybody else in the world is getting the receipt notice and FP..

    Now USCIS is on top of July 2nd and 3rd filers, especially for the applications that were transfered from NSC to TSC. You will certainly get your receipt notices with in a week.:)

    One way to end his mis-information is to make a list of the companies who advertise on his show. After that we need to communicate with these companies about the lies he spews on his show and also threaten to boycott all their products, if they continue to sponsor his show.

    Remember, I can't make a difference, you can't make a difference. But both of us can certainly make a difference.
