Here is the text that is in the I-9 Form:
"Anti-Discrimination Notice. It is illegal to discriminate against any individual (other than an alien not authorized to work in the U.S.) in hiring, discharging, or recruiting or referring for a fee because of that individual's national origin or citizenship status. It is illegal to discriminate against work eligible individuals. Employers CANNOT specify which document(s) they will accept from an employee. The refusal to hire an individual because the documents presented have a future expiration date may also constitute illegal discrimination."
Yes, This comes into picture once company decides to hire. Now hiring is teh last process and beofre that you get grilled in multiple interviews. hi mamit, is this yourfirst time H1B or renewal..and are you doing anything to help this situation ?? like calling what nymbers ?? and did they tell you it was TAL and were you told why the delay is ??
This is my first H1-B visa. I was in USA on an F-1 before that. To be honest, I was thinking that it'd take about 7-8 weeks for this matter to solve as I was also told numerous times when I talked over the phone with Delhi consulate people. I did call the National Visa Center in USA yesterday, but my prepaid phone died before I could get any relevant information. Will call them again soon and will post here about it. So during this whole time, I was only calling Delhi consulate and checking status online at Delhi consulate's website. Now when I read all these posts about delays here, I am a little afraid now. One my friend in US told me to talk to my boss (in US) and have him call local senator/congressman write a letter to DOS. Has anyone ever heard of such thing or done anything like this? Is is a good idea?

If the post is true and from real world person, then the OP and his sponsor are in violation of the Law. The L1B are not supposed to be based/hosted in client location unless specifically stated in the approved petition. Defiantly not supposed to do in case of blanket L1B.

We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.
We need the numbers. I would have guessed roughly 50% of pending 500K applications are from India, 50% of that is EB2, so recapture of 200K visas should help.
I am saying Recapture will only help EB2 and not EB3. Bcoz all the recaptured numbers will be used by EB2 first. So EB2 dates will move forward and then people with PD in 2007 and 2008 in EB2 will use up captured numbers and EB3 will still be waiting to get any leftovers.

Yes, "Interviewing" is not written there. And we all know that "Recruiting" or "Hiring" is not equivalent of "interviewing"
The employer will come up with many excuses to not interview a candidate or hire. If the law doesn't allow you to discriminate when hiring based on national origin or EAD or whatever, rejecting candidates even for an interview doesn't make sense.
Interview is part of the hiring and recruiting processes. Would you say employers putting a job ad saying we will only interview someone from a particular nationality is allowed?
However, the more important point is we are fighting to get multi-year EAD in IV among other things. The law doesn't allow discrimination based on EAD for hiring. Let the govt lawyers and employers figure it out if not even interviewing candidates because of EAD comes under the purview of hiring or not and if it is legal or not.

Can anybody pls help me with regard to my situation.As my kid was born in india Whether i need to apply employment authorisation/EAD (I 765 application) for my kid..We asked the attorney she told u can do what ever u want.Anybody in this situation?or anybody have applied EAD for kids under 14yrs ?

there is one place where you enter petition info.. when I booked online appointment for mumbai.. I had to enter petition info online... it doesn't show up anywhere on any form but we do need to enter it online.

FYI to those who have been affected.... I found the below when searching the internet about this PIMS verification. Looks like AILA is working to improve this system.
AILA members should report any delays greater than 48 hours attributed to PIMS to reports@aila.org, SUBJECT: PIMS Delays. Please see InfoNet Doc. No. 07121070 for more details. Such reports will enable the committee to present any evidence of widespread problems if they exist.

Did you directly get card production ordered or approval then CPO?
Got RFE (sept 10, 2010). was working on RFE (medical report needed)..
Today I spent around $300 to start medical exam report. I've to still to do lab work and may need x-ray. I was working with my swollen arm and got this message..
Your Case Status: Card/ Document Production On September 22, 2010 we mailed the document to the address we have on file. You should receive the new document within 30 days. If you do not, or if you move before you get it, call customer service at 1-800-375-5283.

Now I have to wait.. I will skip tomorrow's lab :confused: and talk to my attorney. Confused yet happy

Airtel call quality is really good and it's cheap compare to reliance....I stopped using reliance almost 3 years......if you pay 9.99+taxes will give you 600 minutes talk time and 45 days validity...I also used for australia and singapore, call quality was great...never had any problems...
