I don't believe votes such as this are scientific. Also only people who like the opinion given by him watches the show, so everyone knows it will be biased.
Anyway I did vote NO.
Last week Lou (who is a Harvard Economics graduate) said he was sending one of his poll results to the WH. Very unfortunate for a non-scientific poll. The other thing is that often a lot of people in decision making capacity ie some congressmen and senators watch Lou Dobbs and are often misled which is why it is key that groups like IV tell the true side of the story. Right now Lou has an anti-H1-B agenda and has been trying to lump H1-Bs as a bad thing for America.

Since 9/11, Pakistani terrorism has become a global issue. Till then it was a local issue.
The Mumbai attacks were highlighted very well in the world media.
That is a big step forward.
War has economic repercussions in these times of recession and open India-Pak war is unlikely, we are all aware of that. But covert operations cannot be ruled out.
Educated Pakistanis like alisa are well-aware of this issue of terrorism. They may try to be a little defensive but that is quite natural I would think.
Alisa, I appreciate that you acknowledge this issue but I will not agree with you that let bygones be bygones because this terrorist encroachments have historical roots. In fact, the whole bloody thing is rooted in history since 1400-1600 A.D when the first islamic incursions began.
Let me stop here...this is my last post on this thread. It does not mean, however, that I'll stop expressing my views against Pakistani terrorism. Not ever.

Palestine was never a country. Even historian knows that there was a kingdom of Israel & Kingdom of Judah. The kings and the timeslines when the kingdoms were destroyed are also known. Due to numerous invasions there was a great diaspora of Jews to the other parts of the world. Even Jerusalem belongs to the Jews. The Romans under Titus burned down the Jewsish temple and killed entire tribes of Jews during the Jewish revolt against Rome in AD. 70. The modern state of Israel was in fact simply returing the ancient land of Israel to the Jews. Kashmir belongs to India. Pakistan has occupied Kashmir.

First - going by your logic - we should perhaps consider returning entire Europe to Italy (since it was all Roman Empire) and also returning pretty much entire West Asia and parts of South Asia to Macedonia (Remember Alexander's campaign?). Kingdoms expanded and contracted based on the power and territoial ambitions of the ruling sovereign - ancient legends should not form basis for modern map drawing.
Second - since when have religious groups started having monopoly over a piece of land?....a geographical entity belongs to the natives of that area.....the natives may follow the same of different religions....Native Jews and Native Palestinians (you may not want to believe it - but Palestinians or philistines as a distinct population group existed even before the advent of Islam) have lived in the modern Israel + Palestine since time immemorial and the land belongs to these natives.....
To blame only Palentinians for the current aggressions is not really fair......and honestly, there is no moral victory or military superiority on display here on part of Israel here either......no one wins when innocent civilians and children die

Employment based GC will exist whoever wins. CIR or any other reform that increses number of immigrants per year (legal/illegal/ammnisity/point system/high skilled/low skilled) may not be possible in new administration (BO/Mcsamebush), unless economy bounce back. Immigration is tiny bit of the big problem facing this country. If the current economny lead to depression/recession what is the use of having GC/USC?
Both are politicans their first ambittion is the office. Country first is simply bull. However, I think BO, is the right choice at this momnet. as atleast he is having professional approch in every problem. He is having little bit socialism. I think economy will boucnce back in BO admin, which is the important issue at this point.

The point missed here is most of us have our GC applications pending at a stage in which we cannot change employers... If we had our GCs we didn't had to worry about this bill ..and a lot of things :(
I am not sure why we are worrying about this bill. This makes restrictions on Consulting companies, so what Clients won't be able to find people, so they do hire people as full time instead of temporary consulting position. That is good for us we can find more full time positions from client it self. I even heard that this bill makes sure H1B are paid by market rates instead of DOL wages which are often very less than market value. Good thing for us the staring salaries would be at higher rate than present rates. This bill is bad for consulting companies but good for us. Am i missing any thing here??

I might be interesting to check with a lawyer whether:
H1B extensions based on I-140 (beyond 6 years) are same as normal H1B extensions(without I-140). In other words, if someone has an I-140 approved does this bill still affect his H1B extension petition(assuming he is consulting)?
We have already checked with an attorney before posting this thread. You are welcome to check with an attorney and post your attorney's opinion here, for other members.

What do you mean by they will give you?
The moment your I-485 is denied, Form the date of denial, your stay is considered unauthorized. You may have to leave soon as possible. If you accumulate more than 180 days and leave the country, you will be barred for 3 years from entering US. If you stay more than 365 days, you will get a 10 year ban. From the date of 485 denial till you leave the country, If you own a home, they know where to find you..if you decide to overstay...

i 485 notice may have grace period on it. One of my friend's h1/l1 was denied (extension) and he was given 15 days from denial date to leave.

Heres what we did, the key is to find a lot/ house that will sell ASAP:
a) Paid a little bit premium for a quickly selling house - in our case we paid extra for a lakefront lot.
b) Paid a little bit less on House itself (new construction - so we selected a less expensive floorplan)
c) combined House + Lot is still in the lower end of the subdivision range.
d) you should aim for the cheapest house in the most expensive community/ subdivision you can afford - on the other side, never buy the house which is more expensive than others around it ... u want other houses to increase ur value and not the other way around.
e) keep good paperwork for regular pest / termite treatments etc. just like it helps in selling the car
f) pay a bit extra for extra insulation - even upgrade insulation for garage door
If we have to sell the house in a rush, we have atleast done everything one could ... rest is umm beyond our hands with all this unpredictability :)

and time again in the eleventh and twelfth centuries.
In their enthusiasm to score brownie points, the Pakistanis have
got mixed up on chronology, they have produced Ghauri before
Ghaznavi. Also, they have perversely sought to commemorate these
Afghan rulers of Turkish descent in utter disregard of the fact
that most of the territories they plundered are their own - the
North West Frontier Province, the Punjab and Sind. The men and
women they tortured, enslaved, ravished and put to the sword were
their own forebears.
If Pakistanis wish to revel in the inglorious misdeeds of
foreigners perpetrated on their own soil and on their own
ancestors, they are welcome to twirl their moustaches in euphoria
and say: " Where ignorance is bliss, it is folly to he wise."
Indians may look forward to future generations of Pakistani IRBMs
and similar sophisticated weaponry named after the likes of
Changez Khan, Nadir Shah and Ahmad Shah Abdali. Alexander the
Great and Harshavardhan also have strong claims, but they might
be disqualified for obvious reasons.
In the course of his many abortive forays into India, Mohammad
Ghori is said to have been captured once by the forces of Delhi.
But Prithviraj Chauhan, king of Delhi, magnanimously let him off.
Legend has it - and it is widely believed in India - that when
Ghori eventually succeeded in defeating Prithviraj Chauhan at the
Second Battle of Tarain in 1192, he blinded him and took him in
chains to Afghanistan along with his friend, the poet
Chandravardai.
Ghori held a grand durbar to celebrate his victory. His prize
catch, the king of Delhi, blind and a prisoner, was paraded and
publicly humiliated. Deeply incensed by the treatment meted out
to his monarch, Chandravardai took refuge to a subterfuge. He
announced that though completely blind, Prithviraj could still
hit a target guided solely by sound, and he asked for permission
for this feat to be performed.
Prithviraj Chauhan was handed a bow and arrow, and Chandravardai
sang a now-famous verse which told him of the elevation and
distance to Ghori's throne. And thus, guided solely by sound,
Prithviraj shot his arrow through Ghori.
The legend may not be entirely true, but it would be absolutely
accurate to say that even after eight centuries have elapsed,
Prithviraj is regularly subjected to indignity in the land where
he was taken as a captive. I have seen it at first hand.
Many years ago, while travelling by jeep from Kandahar to Kabul,
I had to make a night halt en route at Ghazni. At the hotel, I
learned that there was a grand mausoleum over the tomb of Sultan
Mahmud Ghaznavi near the town, and I determined to see it. A few
extra Afghanis (the local currency) helped my driver to
comprehend the necessity of making a small detour the next
morning.
The mausoleum was indeed grand -judging by local standards - with
a high, arched doorway like the Buland Darwaza. lie tomb proper
was in a cellar about four or five feet be low ground-level. It
intrigued me considerably to note that there were no steps
leading down into the tomb. Instead, a metal chain hung from the
ceiling of the cellar. I was told that I would have to hold the
chain and jump down.
I asked for the reason for this peculiar method of entry. The
caretaker was evasive at first. But after much persuasion, he
disclosed that there was another tomb at the exact spot where you
jumped down. There, the infidel king of Delhi, Prithviraj
Chauhan, lay buried.

Why should we waste our resources when Pakistanis are doing the damage by themselves??? The joke is Pak blaming some poor Indian for a bomb blast which was quickly owned up by a domestic terrorist organization!!
Pakistan is a begging bowl which is trying to blackmail US by threatening to pull out troops from Afgan border..so US and UK are trying to pacify India telling them that they will put pressure on Pak to do something.
And you know what a bigger joke is? your slum dog cum president who told Larry King that no one from "his part of the country" were involved in the attack!!! What is his part of the country? his toilet seat??? It has not been 1 year since he killed his wife he was jumping all over Sarah Palin like a horny dog!! Barking dogs seldom bite, so don't just thump your chest just yet. When the fox has to die it runs towards the lion. That is what Pakistan is doing by pretending to pose as if it will go to war with India. If India attacks Pak will fold it's tail between its legs and run to US, like Nawaz sherif did during the Kargil war. Pranab Muks, the foreign minister needs to be applauded (?) for creating a drama of sorts by setting up the army against Pakis assuming that the Pakis will give in to the pressure and return the militants that India is looking for. On the other hand, the Prime Minister ManMohan Singh was consistently giving out statements that India is not in favour of war and never was (completely contradicting Pranab Muks' moves) and as per the latest news that emerged out of nowhere (???) there seemed to have been some kinda communication between the military officials of both the countries and they've come to some sort of understanding that war was not in the best interest of both the countries and only dialogue was as India was apprehensive as to what Pak's response to a military strike wud be...the drama continues and its a big joke. With China playing the mediator and India (silently and 100% dependent on US and UK put pressure on Pak but to no avail) had to succumb to the boomeranged efforts by playing the peace game now. One only needs to wait to see what happens next. But one thing is for sure...India will never strike Pakistan at a point when there is really no open support from anywhere. At some point (yesterday?) the honorable Prime Minister was looking for Iran to pressurise Pakistan (by calling Ahmadinejad) and this in itself speaks volumes !!! India is making a joke of itself...Had it been US, they'd have made a strike at Paki's terrorist sites in no time (as they did after 9/11). Its been over a month of Mumbai strikes and the way India is showing its weakness makes us wonder if they really have solid evidence against Pakistan. At some point (yesterday?) the honorable Prime Minister was looking for Iran to pressurise Pakistan (by calling Ahmadinejad) and this in itself speaks volumes !!! India is making a joke of itself...Had it been US, they'd have made a strike at Paki's terrorist sites in no time (as they did after 9/11). Its been over a month of Mumbai strikes and the way India is showing its weakness makes us wonder if they really have solid evidence against Pakistan. The latest news goes like...The Mumbai Govt has ordered probes into the attacks...Wonder what needs to be probed now(after one month) and that too after the entire nation has been made to believe that it was always Pakistan and claiming and shouting at the top of their lungs that they had SUFFICIENT evidence!!!!

There has never been a mention of the H1b visas approved and those that do not fall under the quota....
This guy is just after his ratings nothing else...his book explicitly quotes that H1b and L1 visa holders do not pay any taxes and transfer all the money home. (CNN has a few hundreds of them on H1b)
When there was a huge debate on illegal immigration he quoted he was all for legal immigration. The only way one can legally immigrate with skills is via H1b visa and he is against it.

IBM and Oracle will survive without H1B as they will hire US workers and set back will be temporary for them. So this bill is targeting the Indian bodyshoppers who are running company just by H1b persons. This was expected for long time. If it is not happening now it is going to happen in a few years. We knew that hundreds of US companies went out of business after 2000 as they were not able to compete with Indian consulting companies because of rate.
What about professional services? Like IBM global services, Oracle consulting etc.... all these companies thrive on after sales customization and support based on professional services contract and there are thousands of h1b visa holders doing professional services. It is also outsourcing of a employee to a client implementing their system. Look at SAP, Siebel consultants, they are outsourced at client places for years together to finish implementations and their work locations are changed based on client's needs from time to time in between jobs - this is again a huge pool of H1bs.
I used to work fulltime for a company in their professional services group and travelled on the job to a lot of places. The company thrives on h1b resources for their high pressured jobs and they always bring in people from outside the country to do their jobs.
I think outsourcing employees to a different location is a part and parcel of H1b, and this bill is nailing exactly on that. It is aimed solely to purge out H1bs from the country.
So all said and done, we may now go down based on a racially motivated bill. I am not sure what it takes to educate the law makers, I would like to see the senior personnel at IV and more analysts to look into what can be done on this bill.

I don't think your view of Indian monopoly in IT is correct. It is a natural flow of human resources from countries which had plenty of it to USA which needed it.
The reason for Indians/Chinese taking up majority of H1B visas is that there are lot of educated candidates to pick from highly populous countries like India and China.
US never gave any preference to Indians or Chinese in H1B visas. The fact is India and China produced lot of graduates who were capable of doing IT work. If you look at it, IT job is not a hard thing to master for any Indian. So US had the necessity for skilled people, India and China had the supply of these people, naturally staffing companies came up to bank on this opportunity. It was a natural evolution, there is no bias towards Indians/Chinese. If you take any small country in the region, they didn't have enough qualified people so staffing companies didn't flourish in those countries.
This is one of those things that people are going to agree to disagree.
btw; my experience with the Chinese is that many of them came here initially on student visa and decided to stay. I don't know many that came directly here on h-1b. They haven't developed the network of staffing companies (main reason I believe is the english issue wheres people from India generally don't have this).

Guys,
Looks like we may see some action from India within hours now. The war clouds have been gathering ever since the Mumbai attacks. But now the signs of an imminent war are unmistakable.
Apparently India had given pak a deadline of one month to hand over the perpetrators of this attack. The deadline expires on December 26th.
Both India and pak have canceled the leaves of their military personnel.
People in border villages of Rajasthan are evacuating.
CNN has been reporting that paki troops are on the move.
If my hunch in right, something big will happen in next 24 hours.

India is not going to attack in your and my life. India has never invaded any country in it's history, (i don't know if it's peace loving or lack of balls), but several invaded, defeated, ruled and looted India. Just being big (1 billion) does not mean anything, you need the guts to avenge/attack, look at Israel, Vietnam if you need examples. Why can few tigers attack the hurd of dozens of dears/buffalos/cows and make them run ?
India could not even fix LTTE, forget Pak.

I am talking about using a different standard for defining R&D. A standard similar to the one used for determining the R&D tax credit. A whole lot of companies other than pure research institutes are eligible for R&D tax credits. And there appears to be broad support for such a definition of R&D.

Let me guess, you work at a R&D facility, right? May be, looking for the best way to fit in your individual situation. No offense meant, however, I would request IV and its membership to have a bigger perspective in dealing whit this bill. Otherwise, 500,000 people will be systematically purged from US. And that includes most people waiting for their green cards.
