Take this scenario.
Under current "mis categorized quota" setup a EB3 takes 6 years to get GC for entire family. take this following scenario.
So the diff
current primary @ebquota - 6 years minimum
current derivative @ebquota - 6 years minimum
correct primary @ebquota - less than 2 years approx ( one person in place of 3)
correct derivative @fbquota - say 7 years.
The diff will be approx 1 year for the derivative ( 7 years – 6 years ) when they are moved from ebquota to fbquota.
again it cannot be more than 7 years ( 2 years primary GC + 5 years primary USC). the primary will get citizenship in 5 years and sponser the wife with in 2 to 3 months. so the diff cannot be more that a year. for derivative.
Remember this point: this is not change of law. this is the correct interpretation of law).
If it is not today some one will bring it up to CIS very soon.
If you are USC and then you are talking abou the FB2. Not for the GC holder. So will have to wait for years.

Per my lawyer,

2. I strongly believe that we should not accept job offers that is not related to the job you originally applied for. My lawyer says it is usually vague and if USCIS determines other wise I will be in trouble. And for the same reason I am hesitant to accept very good employee offer from my current client.
3. Self employment is ok as long as the requirements are met and that is what is I am doing now.

I called my attorney today to inquire about this and he told me that one-third to one-fourth of the applications that he has filed in July are yet to receive the FP notices and he asked me not to worry about it.
Hope he is true and that we will be getting the FP notices soon.

Case was filed on July 6th (485, 131 and 765). Not sure when it reached NSC.
I-140 approved from TSC in 2006.

My priorty date is 17th Jan 2003 Eb3(2)-India.
485 filed on 31st july 2007.
I also got a lud on my I-140 on 27th of july 2008. It is an approved I-140.
Has anyone else gotten a lud on their I-140 also ?

I think it is ironic that we (from India) complain about quota on GC when we are the masters of quotas whether it be in education, workplace, politics etc. I myself was not affected by quotas in India, but I know several friends who were, simply because they were born in "upper caste" and therefore had to be denied opportunities as "revenge" for the injustice meted out by their ancestors several centuries ago, instead of being based on economics.
I personally think GC quota has a rationale behind it. It allows for a reasonable share to go to smaller countries so that the US population maintains its diversity. Besides, near the end of the year, if the numbers are unused, they are rolled over to larger countries like India and China, thereby automatically eliminating the quota.
EB based GC should NOT have Quota (.) We are already IN the system. How will it effect diversity. Diversity visa are meant for divesrsity. EB is skill based and only skill should be cared for,

I am seeing that reedandbamboo is considering for EB2 only. We have to include EB3 too for law-suit. I beleive that we will have more than 1000 people if we inlcude all categories.
I will give 200$( 100$ for me and 100 $ for my wife)
Ofcourse all categories are included...EB2/EB3, I/C/ROW...anyone who is unhappy with USCIS random processing and retrogression of the dates is welcome to join the fight.
Whoever thinks they are in: please send ur Name, Ph# and email ID to GCSTATUS or me.
We are not collectiong money yet..just a pledge. As soon as we hit the required # of pledges, then we start the money collection. This will ensure that it is not one those efforts that starts, but gets buried due to people not participating. They tell me to wait for 30 days and sometime 60-90days.
They say you will become actual permanent resident when you get the card The card is important.
You now USCIS don�t know when they will change their minds.
To better be on safe side to get it stamped on my passport. I took info pass on 8-11-08 it will be almost 30 days,

As replied by Desi3933, it is incorrect to my knowledge. Approval notice it self is a proof that you are a Permanent Resident. The stamp in the passport works for us till we get the physical card. I think you will get it on 9/11/08 9Infopass appointment date).

Thank you very very much fightnow and gsc999 for pushing this forward. As soon as we have confirmation of date and time and location/route, I will send out newsletters to all CA, NV, AZ and OR members who wish to participate. This is going to be good.
Also, I will email all Bay area newspapers and tech periodicals that legal skilled immigrants are having to run rallies on the street instead of designing the routers and the next iPhone.

Pratik lives in San Jose and I live in Reno but I will join this whenever it is scheduled.
