I do not know how feasible this is, but if in your employment letter, there is a description of responsibilities, and additionally a statement like: "The job being offered to XXX falls under O-NET classification 15-1031," then you are completely covered, because the employer is positing that the job being offered to you falls under that classification. Again, don't emphasize technologies etc., just the job description and mainly classification.
The AC21 language is very clear: "same or similar occupational classification"

those numbers.... 60% or 90% are all doctored...... and i'll look at the poll numbers only if both the following conditions are true -
1.) if i've no brain of my own to differentiate between right or wrong, so i must rely on the poll numbers to help me choose my position
2.) if i'm a cheap bastard running to get elected in some useless office ..... therefore i must do what is popular than what is right.... i must give up my conscience and i must choose my position looking at the poll numbers......
i'm afraid that neither of these two conditions apply on me..... so i'll have to disagree with u.....
so much for u'r slam dunk...... come back and read this after the decision by the US supreme court...... state of arizona does not have legal jurisdiction over federal immigration law. no matter how much evil we see around us... this world is made up of good men and women..... AZ will lose..... federal government is asking AZ to enforce the existing law and disband their illegal & illegitimate bill sb1070 becoz its in violation of the constitution of the country..... applying existing federal law will take supremacy over "AZ immigration law" ........

I am in exact same situation. The company that is going to sponsor my H1 checked with two attorneys and both said that I will need a fresh H1 in April07 and I can start working from Oct07. Even I never got to work on my earlier H1. I guess this is because you need previous paystubs for H1 transfer. Let me know if you hear otherwise from your attorneys.

I called too. They told me that NSC needs 2 month to process it--presumably, getting the FP notice out to me.
incompetence of USCIS is beyond comprehension.

You gave me EAD, you gave me AP, you gave me receipts......why did you put me back at the mercy of NSC again? WHYYY? you knew they suck!!!
No FP yet for me or my wife. Been calling CIS.....feels like talking to a wall.
I guess we CSC transferees are DOOMED!!!
There shall be light at the end of the tunnel....or it could just be an incoming train :-)

Preponing visa interview without very valid reason cud be harmful. u never know, if they catch ur wife telling a lie then ull be walking on thin ice.
I disagree with this statement. Your most compelling argument of preponing your visa interview is that they have opened slots which were not earlier available and you would like to finish this process and keep some time incase some additional documentation was required, you would have the time to get it. Also, there is NO RULE that says you cannot prepone appointment.
Also, I suggested you get a fresh appointment at Mumbai (your original appointment was in Chennai - correct?)

You think they will go thru thousands of applications and check the tracking number? Besides I don't think they keep the original mailing envelope. So I think asking us to keep the tracking number is just BS.
If you refer to the 485 processing SOP, the front of the mailing envelope is kept together with the application.

I see everyone firing at each other (junior members, members, senior members, moderators and super administrators).
Here are my two cents to keep yourself calm, composed and dignified
1) Empathy will win friends and support
2) Sympathy you will have only when someone is humble and meek
3) If you lack both the society will ignore you
PS: In a fight the weak always get support, the big and strong are on their own. if they lose no one to cheer them up nor comforts.
Ladies and Gentlemen, you are the only one who can make your choice.

If thats the case then why don't they move the PD forward. EB3-I is stuck in 2001 since last 3 years and its not moving forward at all. How can we get some help here, ombudsman?
After waiting in limbo for so long....even an RFE sounds like sweet news :) . I am hoping its about something simple like Employment verification or something (My company is Fortune 100 , so I don't think it would be about ability to pay). And hoping there are no other delays on the way (like Namecheck etc)
So at last they opened my case. I hope the RFE gets resolved soon, before the dates retrogress or become 'U'. As of now my PD is current in Nov as well. So crossing my fingers!
I hope that other EB3-I cases stuck in 2001/2002 will start getting picked up soon as well and approved. All the best to you all.

Sad to see students being punished like this. They are just taking advantage of the system and make some money, but not doing anything illegal. That's what we are all here for right? Make some money. If enrolling for F1 and working somewhere else is against rules, then why did USCIS issue F1 and CPT to the students.

If you are planning on taking action against the attorney for fraud and mis representation, you may want to file a complaint in the bar of the state where your attorney practices. Bar complaints are taken very seriously and if you have proper documentation and are ready for the fight, he could even lose his license and/or penalized by the bar.

I have nothing against lawyers, most are hard-working and smart. But that smartness also makes them confuse others and ultimately its the clients who have to pay for the smartness of the lawyers.
I am totally against that.

Its not only for illegals but its also for kids of legals that aged out due to retrogression or backlogs in visas...plz don't be selfish with view points like "it doesnt help us so im gonna oppose it"....instead help the children who aged out due to the visa backlogs!!!
