Hi,

Thank you very much for free service.
My brother is working for company X.
They have recently got one labor cert approval. The ads are 3 months old which they used for one employee who is working in exactly his skillset and responsibility.
He is planning to ask the company to do one GC for him in same category.

1. Can they use the same ads for him also.
2. If they can use, then what amount of time will it save for him.
3. What are the different things one has to do, before filing labor like wage determination, with specific employee, and how much time each thing take. Are these tied to any specific employee, or can they be used for others also.
4. Somebody told me if valid ads are there, then it can save him 2-3 months, is it true.

I am kind of confused about my situation. Will try to detail it; any help is greatly appreciated!

I was working with company A until July 2009. They had filed my F1 to H1 COS Application in April 2009, which got approved. I have the receipt for that. I lost my job in July 2009 and found another one. My new employer, Company B, filed a NEW COS Application (which they said is subject to the H-1B cap, which is confusing cuz they could have used the receipt number from my previous approval I think)

Anyway, I contacted the attorney from Company B and they said I should call company A and have them cancel my H-1 COS Application. I called the attorney from Company A and she said she would cancel the H-1 Application. She also mentioned about ME having to send a letter to USCIS. Why do I have to send this letter? Is it so that I can go back to my F1 status? What should it say?? Please help!

Your attorney must have the answer. When you file an I-485, you should include a copy of the I-140 approval or receipt, so your better ask your attorney.

My wife is planning to travel overseas for 3 months and return on AP. Her status is AoS(dependent) as she quit working on H1 a few months ago. Any experience using AP for such long stays outside the country? Please share your experiences.

My brother is coming to USA on L1 visa.
His wife has a valid H1-B stamped. However, her employer cannot send her to US for the next 6-7 months.

Can she come to US on L2 and then transfer her H1-B if whe finds a job here in US? Or will her H1-B get immidiately cancelled as soon as she enters US on L2?

SEP Visa Bulletin is OUT...surprisingly EB2 INDIA 01APR2004, but it was U in the AUG...what is going on....does it mean who ever PD is prior to that date get GC...??

Hi: Need some inputs from the excperts in this group on using the priority dates from a different I140 filing.

Have the following 2 cases filed for the same person.
PD - Nov 2004 - EB3 - Labor Approved - I140 Filed
PD - Oct/Nov 2005 - EB2 - Labor Approved - I140 Approved

If we file I485 based on the I140 approved for EB2 case [which has a later PD], can we still send an update to USCIS later regarding Nov 2005 PD and use that PD once the I140 from the EB3 filing is approved? What's the best way to use the highest EB category and oldest PD in this case?

My I-94 and L1A visa expired on October of 2008. I received my I-797A notice of action and my extended I-94, which is valid until June of 2010. My HR manager said I should be ok as long as I don't leave the USA.

I need to travel outside of the United States for one week. Will I be able to re-enter the USA if I show the approved Petition I-129 with the new I-94 and the expired visa?

Or will I need to go to the consulate to get a new visa stamp extended to June 2010 to re-enter the USA?

I will appreciate your help.

Someone told me that I-140 have to be applied 45 days from PERM approval ? Otherwise PERM will get cancelled. Is that true. Can anyone help here.
