For December 2009 visa bulletin - Please call Ajmeri Baba at +44-91-29-2434343434
Hey! Maybe instead of donating to IV, we could pool some money and get Baba's prediction on Visa movement. I'm sure his prediction would be just as worthwhile/less as Charles Oppenheim's!!!;)

How long we are planing to wait to get stories ? What if we dont get enough numbers to come upfront and be vocal in media ?
I think still problem is there and people who were stuck abroad now have decided not to travel untill they get GC but they are not standing up and joining hands to stop this process.

Here are a few reasons why I want to get the gc:
1) freedom to change jobs to make a higher salary so that I don't have to work two H1 jobs simultaneously
2) freedom to change your career track into another area, which cannot be done even with AC21 (job has to be essentially the same position)
3) freedom to travel out of the country and back in without going to Canada/Mexico each year for revalidation, for not only personal but even urgent busines trips. I get to see my family and friends, and not spend hundreds of $ in govt and legal fees
4) freedom to quit a job because the company/boss sucks
5) freedom to make enough money so that I can take a break from any job for a while (yes, this is actually a possibility if you have a well-enough paying job)
6) freedom to have one's dependents take advantage of benefits like in-state tuition, and other benefits residency brings
7) and finally freedom from the immense stress that I will lose my job and consequently all the time I have spent waiting for my gc, perhaps uproot myself and have to return to a place where I may not necessarily feel is home anymore
So am I doing what I really want?
No
I guess black Americans could have said something similar 200 years ago: as long as I am fed by my master, he provides me with a roof over my head, and I work hard, I should be happy.
Today they would still be slaves.
To misquote Orwell: America is a free country, but some people are freer than others.
Moral of this story: Satisfaction and complacency are two different things
Interesting blog on the issue of high-tech slavery.

Conference Call on Effective Posting - tomorrow, July 21st at 7:15pm
How to Post for Maximum Impact
Conference Call tomorrow night, 7:15pm Central
Labor Day marks the beginning of national discussions on the corporate visa programs that allow companies to legally bypass the US workforce. Most tech workers see this bypass and confront this bypass when they are looking for jobs. But most recent college grads will never see or confront this issue because they will never be considered for jobs their degrees qualify them to do.
This is the power of employment discrimination. This issue will be part of a national conversation on comprehensive immigration reform if we tell the truth about our own circumstances.
Businessweek will be posting their article on H-1b exploitation on Wednesday. Join me to discuss why the "culture of bypass" is the necessary precondition to create the "culture of exploitation."
Scheduled Conference Date: Tuesday, July 21, 2009
Scheduled Start Time: 07:15 PM Central Daylight Time
Scheduled End Time: 07:55 PM Central Daylight Time
Type of Conference: Standard
Dial-in Number: 1-219-509-8111
Participant Access Code: 798504
Reservation:
NO, just dial in at 7:15pm Central

This culture of exploitation among IT labor contractors could not occur without the legal protections to bypass the US workforce. This is why the corporations are fighting hard to defend this protection and defeat the Durbin bill (S. 887).
Readers may not make the connection between this corporate malfeasance and the bypass of qualifed citizens and green card holders - but your posts can. Make sure your posts mention the Durbin bill (S.887).
Here's some talking points on corporate protections affored by visa programs:
* The H-1b corporate visa program is responsible for these crimes because it protects corporations from ever considering local talent and opening the door to this culture of exploitation. Passing the Durbin bill will end this culutre of exploitation.
* Protectionist measures in the current corporate visa programs are poisoning the IT industry - no corporation should be protected from the consequences of discriminatory hiring practices.
* American labor laws and EEO have had a powerful impact on American society. These visa programs protect corporations from employing a workforce that knows their rights and can exercise them. That's why corporations don't want the Durbin bill (S. 887) to pass.
* Far from protecting the US workforce, the Durbin bill (S.887) will give us a chance to compete for job openings in our own country, thus preventing these corporate crimes.
* It's the responsibilty of the federal government to ensure that we have the freedom to compete- and we will get this freedom to compete when S.887 passes.
* If these companies were required to seek local talent first, these shakedowns would virtually disappear.
* The discriminatory practice of recruiting abroad for US job openings now breeds a form of exploitation unimaginable to 21st century Americans. These cheats could never swindle Americans this way.
Our posts promoting the Durbin bill will be watched -- and measured -- by Congressional supporters of the Durbin bill and all of the players who will be at the table when this issue comes up in the fall.
Your posts supporting the bill and defending American labor and talent will let all the players know that American IT professionals are standing up for what they want and shaping the circumstances of our lives.

Looks like we are all frustrated, and it is proving beyond doubts.:(
It is best to wait for USCIS to announce this. If this is going to be true, then lots of people who had the hopes of applying for their I140 is just gone.
IV core team, can you please find out more information on this and let the members know.

This discussion scared me now.
I came in US on 06/03/2001. When I came I was told, no project for me right now and I have to wait. I waited till 09/11/2001 WITHOUT pay.
The first time I was on my company payroll was in 09/11/2001. Since then as of today I am working continously.
AM I IN PROBLEM?
Please comment and give me hope.

Just venting out on IV Forum will not get us anywhere.
Our lawmakers are unaware of the issues that affect us and it is really upto us (each one of us) to educate them.
The most important thing that somebody can do for themselves is to take an appointment with your congresswo/man's office and talk to them. It is not that difficult. Just 1 hour of your time.

I understand so Many of us are looking at the Options of Using AC21.
I am currently looking for a Good Attorney for this.
I have contacted Sheela Murthy's Office and Rajiv Khanna's Office.
Both of them are very very expensive.
I am looking for an Attorney who charges under $1000 and also knows
about the Immigration Matters.
I would appreciate any pointers and suggestions in this regards.
Ellen Krengel - Good and reasonable (google for telephone)
Christine Troy, Attorney at Law - tel 415-399-9490 - Good and reasonable
Helen Konrad - Tel 804-775-3818 - good and reasonable
Kapoor & Associates - Phone: (404) 685-9940 - found reasonable, talk to them and finalize
K K Rastogi ESQ - Ph: 212-279-4403 - talk to him, I did not talk to him.
Andrew Dutton - 917-536-5940 - I did not get a chance to talk to him, but heard he is reasonable
Good luck

Miss. Murthy reports that LS was rejected for some folks.
How does one get to know if his Labor Substitution was rejected? If a Receipt Notice was received does that mean that it was accepted? And, can they reject it later?

Its not all about being Wise. I was stuck in a BEC for some time, but my company refused to refile under PERM for me.
Folks who missed the window - believe me, despite some insensitive remarks now, and in the past, IV is here for you and is working on your unfortunate predicament.
My best advice to those affected by the continuing BEC mire is to join your state chapter, make sure your voice is heard on a local, grassroots level.
