My friend, there is a LOT of difference between the words "rant" and "idea". It is very difficult to confuse between the two:

going back to india is a personal decision, and each case differs. circumstances are key in this decision process. one or more members' past experience in india will not apply...
for the people who decided to go, if you want to share your decision, please do and may be post on your experience once you have reached and settled in india.

It is possible that check depositing staff also has there own back log. Once, application and checks are accepted, EAD can be issued, but check depositing staff may be slow in their work.
I hope that is the case. I just checked my account and still the checks have not been cashed..... I will keep you posted if there is any change

I got my H1B renewal notice last week. My application�s received date is in 3rd week of Jan and Processing date for H1B extension is still in December-07.
Yes this was a recent change in the way they reported processing dates. Instead of reporting which date they are working on "now", they now publish the receipt date of the earliest application that is still being processed.
That explains the "retrogression", if you will, of processing dates of TSC after the initiation of the new NC rule. A lot of applications stuck in NC suddenly became available for processing, and hence the RD of the "earliest" case under processing had to be moved back.

On a serious note, there have been 4 cases approved today(from other site - 2 cases from India and 2 from ROW). So looks like there are some ROW applications also in queue during this time of the year getting approved. I saw someone from EB2-ROW getting 485 approved (filed 140/485 concurrently) in a record time of just 30 calendar days(Filed on July 26th and approved Aug 25th). Never heard USCIS was so efficient.
Looking at the positive side, since they are still approving ROW cases, it may mean that spillover is still happening and there are visas available.

So you are laid off so what is the big deal? You should be able to negotiate somehow or escape layoffs by doing something or the other. There are people in my company who survived 6 layoffs. Your layoff is your problem and nothing is fair in the globalization.

Is there any way we can work for our US employer from India on Indian salary? I am thinking a consulting company with presence in US and India (Manpower??) can set this up for us. So we will just be living in India and working remotely for the employer as a consultant. We will be paying indian taxes as the consulting company will be indian. Any thoughts?

I came to know my wife's application is pending for finger printing. I was told she will be getting an appointment notice. Should I wait for notice or can we just walk in? This is what I don't understand. Priority dates are set so only applications before that date can be approved. Processing dates are not set in that sense of the term.

So in that sense, "not moving the processing date" does not make sense. Unless you mean they deliberately reduce the number of hours they work so fewer applications are processed.

During July 2007 fiassco, many members of IV experienced that files were flying between nebraska and california centers without apparent reason. If you have followed processing dates in past you would surely have obeserved dates not moving at all for months. Does that mean nobody was working at USCIS at that time? No.. What it means - " We have heavy work load and we want to go in particular direction and so we are delaying" - in terms of USCIS. In our interpretation - USCIS does not work and want us to rot forever.

I asked my employer if they would tune the clauses to "1 yr after EAD" but they said NO - "it will be 1 yr after GC"
They also told me over phone that they have the capability of revoking
140 and complaining against me to INS if i try to leave before getting the actual GC.
Can they do that - after 6 months they lose that control - Right ??

I landed in Ca in Jan 08. my 485 pending. I had expired h1 when landing. I went for h1 stamping in Toronto during the trip. at the consulate you have to disclose you status in Ca. I told I just landed yesterday, and the officer congratulated me, and I got h1 renewed for 3 years (my h1 was renewed after my I140 was approved, but before I applied for 485 - so 3 yrs extn).
at the windsor border (drove by car), I even disclosed to guy that I landed in Ca. He did not say anything, but just asked to show my vehicle registration. Also he asked if I don't have to then live in Ca, I told him it's not necessary until after 3 years to maintian my residency there. He said Ok and let me in.
again it's better not to lie about you Ca pr, coz there's the landing stamp on your pp, even if you removed the document stapled on your pp.
again i've been to Ca twice since landing (with the doc staped on my pp). no problem re-enterin US.

My intention was more to think in right way and discourage potential -ve result bound strategies.
During presidential campaign there were all over promises on clearing backlogs, we can go on that basis and make a point of that.
One thing is clear if they like to stop outsourcing sure they have to encourage and stream line legal immigration they cannot stop or survive but cutting outsourcing as well leaving this legal immigration in limbo.
Besides what we can do at this juncture, keep our voices heard by contacting, writing letters.
1. In a world leading country processing a decade back applications is not an encouraging trend to legal immigration, this may send a wrong signal to legal immigration over illegal immigration.
2. Can highlight ecomonic point based on these math...
Ex: 500,000 EB backlog persons contribution to the country, social taxes = xxx, medicare = xxx, travel=xxx, housing =xxx.

Wondering how they would adjust to the tests, languages, discipline etc etc
My son is 20 months old right now. I don't think he would have the slightest idea of how US is :) . He is going to enjoy the same education system which churned me out :)
When I went last time, I checked out the schools. They are not bad as I thought. All are improving. Since my son is a US citizen, he can easily come to US for college education.

We finally got the CPO email for my wife and I today morning.
Had done all the follow-up like SRs, Infopass, Congressman inquiry. Not sure what worked.
After 10 years, we are finally greened. I sincerely hope for everyone who is current to be greened in time.
