I graduated in Dec 2008 from USA and then returned back India. My F1 visa is valid till dec 2011 and am planning to come back USA for pursuing my phd. I got I20 from a different university. Do I need to attend for f1 visa stamping again ? . Please help .

YES, (1) in the same line of specialty area (2) and full time & part time employer should permit taking up another job (ie. some employers ask you to sign a agreement not to work for another employer during the employment with them)

Please use this money for constructive tasks.
Since first day, if u have tried to make I485 filing w/o priority date current..
At least 90% of people wud have utilized AC21 and change employers.
Ofcourse you always convince the higher authorities, to let us file 485s and issue GC, when dates become current.
As long as we file 485 and utilize AC21, we will be in safe situation.
Have some plan and result oriented plan.
Thinking big is ok, but we shd know what actually we can do.

Pew confirms what we've already assumed is happening. The number of illegally present immigrants has dropped 8% since 2007. The number is now about 11 million, down from peaking at 12 million. The annual migration of illegally present immigrants has dropped from about 850,000 a year a few years ago to just 300,000 a year today. Why? Hello, My parents on B1 visa just entered the US a few days ago. This is their 2nd visit. I extended their stay beyond the given 6 months when they came last time. My mother got a 6 months term on her I-94 this time which is ok but my dad was granted only 60 days of entry and he said the immigration officer has marked in Black marker pen saying "No Extention" on his I-94 card. The justification they gave was that they were unable to find his previous extension, but if they were unable to find his extension, how could they even permit his entry in the first place since overstaying without extension would be illegal.
My question is with "No extionsion" marked in writing on my father's I-94, could I apply for his extension beyond the granted 60 days?
Please answer this question so that I can take the needed action.

For how many years does the employer have to guarantee that it has funding to pay my salary? Or how does this thing work out. My employer has 300+ employees.

As many readers may know for I-129 that is used for H, L and O Petition has been revised. On December 20, 2010, USCIS informed stakeholders that it will accept previous editions of Form I-129 that are postmarked on or before December 22, 2010. Petitions postmarked on or after December 23, 2010, must include the new Form-129 with a November 23, 2010, revision date or else they will be rejected. This contradicts earlier guidance stating that the last day USCIS could accept previous editions of the form was December 22, 2010.
We hope that this update clarifies some of the confusion regarding the last date the old form can still be used.

ICE has announced sentencing in two cases related to visa fraud. Houston immigration lawyer Kenneth Rothey has been sentenced to fourteen months in prison for money laundering and visa fraud. Rothey was convicted for his role in securing L-1 visas based on manufactured corporate relationships. ICE also announced the sentencing of Kwan Tsoi to nineteen months in prison for her role in arranging fraudulent marriages and then submitting immigration applications based on the marriages.

I have been working as a consultant, due to the tight job market conditions I am not able to find my next contract in bay area, which was my current location when we filed I485 in Aug 2007. So, may be we got to relocate to other state say Texas. So, I was wondering what would be the impact of the move on our pending I485 applications after we change address using AR11 form. Should we avoid such move while I485 is pending?
Any Advice/Suggestions?

I have a situation where I need to dump my emp after working for almost 6 years as I am getting new opportunity which requires emp to pay me on 1099(instead of W2). Can it be possible and also can I avoid opening LLC. Also, not sure if in the near future if I get a RFE how that would go with current situation

I think answer is NO if you want to come back of L1A from B employer.
To be eligible for L1A, You need to be on outside USA payroll from B employer for atleast 1 year (from past 3 years).
With H1B, you will be on USA's payroll for that period.

My spouse qualifies under cross-chargeability, she filed her I-485 application after mine, with me as the primary applicant. I never mentioned anything about cross-chargeability in my application.
Now the PD is current for "all -other chargeability" how do I check if my I-485 application is going to be picked up?
Any ideas how I can do that?

I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.
Please suggest me what i have to do.
