The whole idea of this campaign was to get media attention and publicize this issue as much as possible, which we all know that it did just that quite effectively despite all the apprehensions and reservations expressed.
This campaing was never thought of as a panacea for all our problems, whether it will lead to a fruitful or POSITIVE result that is still unknown. What is known is that this drive has provided some much needed traction and attraction to our cause, which is the important RESULT at this point in my opinion.
All I am trying to say is that we should give some thought and imagination before discounting or discarding an idea even if it appears to be far fetched at first. Any idea proposed which is out of the ordinary will be meted with reservations and oppositions, after all its nature's law that there is always resistance to change,:rolleyes: good or bad.
I don't want you to be eating your words :D , I know for sure that you want this problem resolved as much as anyone else on the forum.:D
Everyone has right to be SKEPTICAL and even I am SKEPTICAL about the final outcome of our over all struggle, but I wasn't SKEPTICAL about the outcome of this campaign.

On what basis you are saying that Oct'2008 PD will be similar to Jun'2007. Didn't you read the note in Sep'2008 VB that PD for EB3 category will retrogress further.
If you cann't support EB3 community then at least don't misguide people here. EB3-I is in severe pain right now and people like you can't understand it.
The EB-3 the Visa bull is talking about is that of EB-3 other workers not for general EB-3 category..
In Jul07 they gave away lots of Visa to EB-3 so from earlier years they may not be much EB-3's left..I am guessing..so it may actually start off at Mid of 03..

What part do you want interpreted? It says in plain simple english that it is wating to be assigned to an officer.
You can take an infopass to find out if your case is pre-adjudicated, prints/name check are clear.

Campaigns are good. But to solve this problem we have to go back to the basics of human nature, specifically how or what motivates politicians -
1. Votes
2. Money, Fame, Power
3. Good publicity or fear of bad publicity
We can not give #1 or #2 to the politicians. So our only option is #3. This was the reason why the flower campaign had worked, they feared bad pubilicity.
Again, they will not move even a single inch unless there is some motivation and as I said above our only option is #3.
And for doing #3, the community must cooperate.
If you have noticed, IV has done various campaigns in the past, though results are not guaranteed, enough publicity and buzz has been created and now we have more people uniting.
It takes time for big things to happen.
Mountains can be moved only by motivation, in fact #1 and #2 can never move mountains.
in 1970s, America opened up green cards to doctors, engineers and chartered accountants from India. A lot of doctors migrated that time and after a while there was heavy resistance from local people but govt cannot stop people from coming, so they implemented harsh rules to appease locals. One such rule was, even if you are a professional - you cannot take a job offer without going through the employment exchange. And in the employment exchange the job they give does not necessarily be the job that you can do. This discouraged new people and many people went back though they had green cards because they did not want to ruin their careers. Everything was good till you land here and no one told u about this situation. People never realised it till it hit them hard and as usual our community is scared to rise and no unity and no one speaks the truth, everyone just painting a rosy picture that they are doing great.
So, I would only say "Don't look at the result", just keep doing the effort. Try to build trust among the community. In fact you will be surprised to see that it is easier talking to the govt to help you rather than talking to the many unmotivated people who want benefit but are not motivated to do something about it. Keep those people in mind and do somehing to change their minds and set an example.

Here is the text that is in the I-9 Form:
"Anti-Discrimination Notice. It is illegal to discriminate against any individual (other than an alien not authorized to work in the U.S.) in hiring, discharging, or recruiting or referring for a fee because of that individual's national origin or citizenship status. It is illegal to discriminate against work eligible individuals. Employers CANNOT specify which document(s) they will accept from an employee. First of all, they cannot ask you for you work authorization during the interview process. Second, even during hiring time, they can only ask you if you need sponsorship for H1 or not. If at this point you say no, then they have no business asking you for what kind of work authorization you have (unless the job specifically asks for US citizen or security clearence).
That's true actually. They have no business asking you about details of what your work authorization status is. All they need to know is that you are legally allowed to work. I checked with USCIS by calling them and they still have no records for me in the system. They admitted that there are many who have not been entered and issued receipts even though the dates at NSC & TSC shows otherwise.
Adviced to be patient and call back in October 1st week. According to them its still not long enough for them to launch an inquiry to find these July 2nd applications.
My lawyer also says she can't do anything yet unless they say that they have filed everything they have received.
Again what a mess ...waiting for reciepts takes so long wonder when they will finally process the GC.
I know many 2nd July filers who have even received EADs.
I hope our patience pays off and they rewsrd it with giving the GC straightaway;).....wishful thinking.....

The way i read that statement is that DOS is being cautious and don't want to move the dates way ahead at one go, dates will move by some degree in May and then bulletin will have projected dates for future months, this way if DOS sees demand from porting in Sept, it may not move EB2 dates at all...My 2C.
If they add EB2ROW Fall across numbers(6-8k) from first 6 months it will be 20K towards EB2IC backlog. USCIS may need buffer since all pending cases are not pre-adjudicated and some cases will be denied.
20k can clear all back log until 01-JAN if they need buffer they can move to 01-MAR-2007( 2 months or 5k) or 01-MAY -2007 (4 months or 10k), worst case can go to 01-AUG-2007(7 months or 15k)! my guesstimate.;)

Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always �current�. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That�s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 �ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 EB3 visas.

Only the cases either transfered to local office or consular processing were getting Approval. It was weird situation because no numbers were getting used hence all numbers were available. My priority date is current now and my company has already filed for my I-140. I have have two questions:
1) My wife converted from H4 to H1b last year end and she has not gone out of the country to get any H1b stamp. Will this complicate things? Does she need to go out to get a valid H1b stamp? In case of any trouble, will it be easy for us it she converts back to H4 again?
2) I saw that I485 processing times are taking about 6 months at the CA service center. Hence, under the current conditions, what is a better choice go: for Consular processing or Adjustment of Status? Thanks. :confused:

It may not have any impact on EB3 this year...but once the EB2 is cleared it will have an impact on EB3; may be in a year or two.
